ProcedureEdit

1.The applicant starts by acquiring ownership of a given land / property. Ownership can be acquired through written agreements for instance after purchasing land, receiving donation and through exchange. It can also be acquired by inheritance or any other means recognized in the country. In both cases there is there shall be the 1st owner of property and New owner of property who is the applicant who come into agreement and there a transfer agreement should be drafted and signed to prove that land / property has been transferred to the applicant, the agreements drafted can either be a purchase / sales agreement, donation agreement, exchange agreement, inheritance agreement or any other agreement depending on how the new owner acquires land;

2.Thereafter the parties proceed with obtaining the Extract. In this case, the two parties obtained the extract from the Commercial Register held in their respective District Court or from a notary; which is either drafted on paper or electronically. Where a party decides to use a notary, he / she must ensure that the identified notary is legally authorized to office the required services;

3.After obtaining extracts the applicant proceeds with verifying signature of 1st owner of property. In this case four (4) signatures are submitted for verification of signature on the transfer agreement to a notary or the registrar;

4.After verifying the signature of 1st owner, the applicant proceeds with Submission of application for registration of a transfer with the competent district land registry where property / land is located. This is done by obtaining and filling an application form and therefore submit it together with the required documents to the registrar;

5.Upon receiving application, documents are examined and assessed to enable the registrar make a decision. In this case an application may be accepted or rejected;

6.If application is approved, the property is transferred to the new owner and an original land title is issued;

The fees are as below:-

1.Obtaining extracts fees are as below

  • Two Paper Forms EUR 13 (EUR 6.50 each)
  • Two Electronic forms EUR 0.66 (EUR 0.33 each)
  • Notary fees (two paper form) EUR 5.32 (EUR 2.66 each)

2.Verifying 1st Owners signature fees differ basing on where verification is done as below

  • At the registrars office EUR 1.50 (verifying four (4) signatures)
  • Notary EUR 1.99 (verifying four (4) signatures)

3.Transfer fees / Registration fees

  • Registration in paper form EUR 66 (Normal procedure)
  • Registration in paper form EUR 266 (express procedure)
  • Registration in electronic form EUR 33 (Normal procedure)
  • Registration in electronic form EUR 130 (express procedure)
  • Income tax paid by seller 23% of property value (incase land was acquired out of purchase / sale)

InstructionsEdit

1.to obtain an original and title, an applicant must be the owner of a given property;

2.signing property payments and clearing agreed fees is not ownership of property;

3.after acquiring property / land it is advisable to register ownership with the Land Registry;

4.applicants must ensure that drafted transfer agreements comply with the formal and legal requirements of the land registry;

5.In cases where an electronic extract is obtained, an applicant must ensure that the signature inserted is certified as true;

6.An extract may be obtained from a notary or district court;

7.A transfer agreement can either be drafted by the two parties involves in the transfer agreement, by a notary or lawyer;

8.Applications are filled at the offices district registrar in most cases where property / land is situated;

9.Application can be submitted either manually or electronically;
