Procedure

Apply In-Person:

1. Every person desiring for the grant of poison storage licence shall apply with the office of their respective district magistrate / collector / the designated authority as applicable as per the respective state norms.

3. Please go to the respective office and meet the designated authority at the licensing section. The applicant shall get the advice from the authority to be followed to apply for this licence. Please collect the application form or write on a plain A4 sheet as advised.
4. Complete the application form. Write a covering letter mentioning the purpose for which the licence is required. Attach the required documents as per our “Required Documents” section of this page and submit it to the designated receiving authority in triplicate. The application shall bear a court fee stamp of ten or one hundred rupees, or as per the advised value.
5. After receiving the application, authorities will check the submitted application and document set. If all are in place, the application will be accepted. Please pay the application fees/charges as applicable and don’t forget to take the receipt.
6. Authorities will make entries about this application in the manual record or electronically using the computer, listing out the date of receipt of each application and each application has to be given a specific number.
7. Authority will sign and seal one set (photo copy of the original) of the application and return it to the applicant. This signed application with application number is the proof for the submission of your application. Please keep them safe for future reference.
8. Applicant will be informed of the probable date of getting approval for the licence.
9. This application will be processed further. Concerned authorities will verify the applicant’s details and documents. A ”SMS” triggered update on application status will be sent to the applicant’s mobile.
10. The licencing department will forward this application to the respective office for getting clearance from local police, traffic police, chief fire officer, electrical department and land owning agency as appropriate.
11. Once the above department's clearance is sought through report, an inspection team/authority will be nominated to inspect the premises physically.
12. On a scheduled date, the concerned authority will inspect the premises and make verification of the facts as per the application form. Authorities will inspect the facility to make sure that the applicant has followed department norms in keeping the safety of the employees and surrounding.
13. A report will be created after inspection and this report will be submitted to the respective licensing authority.
14. Based on the outcome of the above reports and other internal processing, the designated issuing authority will take a decision on issuance of this licence.
15. The status, viz. Approval or Rejection if any will be conveyed to the applicant through an SMS or through phone call.
16. Once approved, the licence will be hand delivered or sent through post to the address mentioned while applying or issued as per applicable norms.

Note :

• A copy of these rules shall always be displayed in a prominent position by the licensee at the place of his business.
  
• A licence shall be granted only to a person who in the opinion of the licensing authority is competent to conduct business in poisons.
  
• Applicant has to bring original documents while applying for cross verification purpose.
  
• Without cross signature on photograph and signature on undertaking, the application will be rejected.
  
• The competent authority has the discretion to refuse the licence if it appears to him/her that such place may cause obstruction, inconvenience, annoyance, risk, danger or damage to the residents in the vicinity and the applicant is not a suitable person.

Required Documents

• Application form
• Covering letter (with full detail of the quantity and purpose of poisons for which licence is to be applied)
• Residence proof of applicant (ration card / passport / aadhaar card / driving licence)
• Identity proof of applicant (ration card / passport / aadhaar card / driving licence)
• Character certificate from police department
• Proof of ownership or right of possession of premises, viz. sale deed or lease-deed or allotment documents or rent-deed duly signed by the applicant (6 copies)
• ”NOC” of local body (municipality / village panchayat)
• Self-attested “NOC” from landlord, in case of tenancy or lease
• ”NOC”/Clearance from the respective state pollution control board
• Site plan/key plan and structural safety certificate attested by an authorized architect of the proposed site duly verified by the applicant (6 Copies)
• A self-attested affidavit, containing general information in respect of the applicant on stamp paper of Rs-10/- (or for the advised value) along with its necessary enclosures signed by the applicant
• Proof of date of birth
• PAN card
• GST registration certificate
• IT returns preceding 3 years
• Documents regarding constitution of the applicant firm, including nomination of the authorized representative
• In case the applicant is an employee or a representative of any firm or company, an authority letter in favour of the applicant or signing authority or person issued by the firm or company, accompanied by certified board resolution
• Aadhaar card of applicant/applicants. In case the applicant does not have aadhaar card, a written declaration in the form of an affidavit to be submitted in this regard along with an alternative identification proof which may include passport or voter's identification card or permanent account number (pan) card or identity card issued to the employees
• Every application submitted by a company for the grant of licence shall be accompanied by the following documents, namely:-
  • Original copy of the board resolution passed or an authority letter confirming the appointment of responsible person
  • Certified copies of the founding documents of the company, including memorandum and articles of association
  • Medical Certificate, especially about mental health of the applicant, with specific mention that the applicant is not dependent

Eligibility

• Applicant should be citizen of India.
  
• No person below the age of 18 years shall be eligible to apply.
  
• No person who is addicted to intoxication or of unsound mind shall be eligible to apply.
  
• Applying firm or enterprise must be a registered organization.
  
• Those who satisfy minimum floor area and maximum floor area requirement for a firm as per respective state norms are eligible to apply.
  
• Applicant those who are not having any proceedings / cases instituted against them in the “CBI”, “NCB”, enforcement directorate, directorate of revenue intelligence, income tax and forest department are eligible to apply.
  

Fees

• Please pay as authorities quote while applying.
• Charges for court fee stamp need to be paid.

Validity

• The issued licence will be valid for 5 years (in some states the licence is valid for 3 years only) from the date of issuance as per the issuing state.

Instructions

• Any executive magistrate or a police officer of the rank of sub-inspector and above or a medical officer appointed by the state government or an inspector may at any time visit and inspect the premises of the licence holder where a poison is stored and may inspect all poisons found therein and the registers.
• Statutory Warning: Mishandling and misuse of poison shall constitute a serious criminal offence under the law.
• Please follow the guidelines fixed by your state for size of the premises and zones meant for starting these establishments for which the certificate is required.
• Do not submit fake documents as a proof to obtain this certificate.
• Incomplete application will be rejected.
• Avoid spelling mistakes while filling the application form.
• In the event of any information provided by the applicant while applying for this certificate is being found false or incorrect or ineligible before or after the issue of this certificate, then the certificate is liable to be cancelled and the applicant shall be liable to such further action as may be provided under the law.
• There will be checking on character and antecedents of the applicant from the Police Station records.
• Traffic authorities will check whether there is adequate space for the movement of vehicles inside the proposed premises.
• The premises should be safe from fire safety perspective and escape route point of view.

Need for the Document

• No person shall sell or possess for sale any poison without a valid licence.
• This licence is granted once the clearance is obtained from all the regulatory departments (police, traffic, fire etc.). In this context, the safety and other mandatory requirements are fulfilled for a smooth operation.
• Apply and obtain this licence for a legitimate operation.
