Senegal - Request a Judgment Authorizing for Late Marriage Registration

Apply In-Person
- To obtain a Judgment Authorizing for Late Marriage Registration, the person concerned should file the request in six months after the marriage not declared in the civil registry, visit the registry of the departmental court of the place where the marriage was celebrate or where the spouse reside for the issuance of the judgment. - Submit the request attached to the supporting (as mentioned below) to the verified by the court chief clerk at the departmental court.
- Note: The physical presence of witnesses is compulsory
- The clerk will then verify, if all the necessary information and documents have been provided and that the applications comply with the selection criteria, if everything is in order, you will be issued a payment invoice by the chief clerk.
- Proceed to the nearest General Directorate of the Treasury and Public Accounts office and make payment against the invoice and obtain a payment receipt. (Please view address/contact details below).
- Note: In the event of a fairground hearing, the cost is reduced to the costs of issuance only.
- Upon making payment return to the departmental court and submit the payment receipt to the court chief clerk, the clerk will then forward the application file to the competent court for evaluation and consideration.
- In the event of a normal hearing, a court date will be set and the applicant accompanied by his/her witness should be present for the court hearing proceeding, the court will then make it ruling as per the sworn testimonies from the witness and the due diligence report as conducted by an officer of the law.
- In the event of a fairgrounds hearing, the court will periodically organize and mobilize the audiences. The court will then travels to the place of residence of the applicant, to make declarations of marriage to civil status officers.
- If the court ruling is in favor of the applicant, an extract from the minutes of the judgment of late authorization of marriage will be drawn up, signed, and stamped by the court.
- This extract is sent directly on the slip, by the Chief Registrar, to the competent registrar, for transcription.
- The civil status center (CNEC) chief registrar will then register the birth into the birth registration record, applicants can then proceed to apply for a marriage certificate if he/she does not have one {Refer to wikiprocedure website; Senegal- Apply for a marriage certificate, for full procedure)

- A certificate of non-registration of marriage
- A certified copy of the identity documents of the 2 witnesses

The following fees are chargeable;
- 4,000 FCFA for enrolment
- 600 FCFA for the issuance of the document

Important notes:
- When a marriage has not been registered within the legal period of six months, late registration in the marriage registers of the civil status center requires authorization from the judge, in the form of a judgment.
- The marriage registration authorization judgment is therefore the only way for a person whose marriage has never been declared, to have a marriage certificate.
