Romania - Obtain Birth Certificate

ProcedureEdit

Civil status certificates are issued to the persons entitled upon the drawing up of an act in the civil status records - birth - or later, on the basis of the application filed by the holder or other entitled persons.

Apply In-Person:

Visit the registry office in municipality where the event was registered, request for the issuance of the birth certificates can be made: at the mayor's office keeping the registers in which the documents at the mayoralty of your place of residence or residence.
Request for the application form from the service counter or you can down load it in advance through this link (in Romanian)
Attach all the required document and submit for processing of your certificate. If you have a damage or old certificate make sure to attach it with your application
You document will be produced and issued.

NOTE:

minors with identity documents assisted by one of the parents or guardians
minors over 14 years of age who have never had an identity card or for those who are forbidden to issue a birth certificate at the request of their parents or legal representative

Apply through a Proxy
If you are unable to make the application personally, you can choose to a representative to make an application for you provided that they are eligible and have the necessary documents for the application.

Apply from Abroad
If you are living in abroad, visit the nearest consulate to make your application, you can contact them prior to your visit to enquire about the documents they will require for the application.
Note:

It is advisable to produce old damaged certificate when you are applying for replacement, otherwise you will pay a fine if you are not able to produce the certificate
It advisable to fill the application from and attach documents in front of a civil registry officer.
If the person is arrested or detained submit the application for the issuance of the civil status certificates to the state of the state where the detention facility is located by the administration of the place of detention certifying the identity of the applicant

Identity document (bulletin, identity card, provisional identity card for Romanian citizens domiciled in the country)
The passport - for Romanian citizens residing abroad or foreign citizens whose civil status documents are registered in the country; citizens who do not have identity papers will be advised first to request the issue of the identity document with the Home Register Service or the Passport Service
If the new type of civil status certificate is required, it is necessary to hand over the old certificate for cancellation.

Documents to be produced by a proxy

Identity card / identity card of the mandated (empowered)
The special power of attorney.
PROCURA may be drawn up at the diplomatic mission or career consulate of Romania in the country where the mandates are domiciled, resident or temporarily resident.
PROCURA may also be drawn up by a notary in that country, in which case it is necessary to apply the Apostille under the 1961 Hague Convention, or legalized. As the case,the PROCURA will necessarily include the following elements:
- Name, surname and domicile of the person who mandates
- Name, surname and domicile of the person mandated
- The subject of the mandate that must be special (indicate the civil status document to be obtained by the trustee, the indication of additional data on the place and date of the act being concluded).
- the original purchase if given to a notary abroad must contain the apostille according to the Hague Convention, or be legalized, as the case may be
- Translation in Romanian authenticated by a notary public.

EligibilityEdit

All births that recorded in Romania are eligible for birth certificate and to obtain duplicates of lost or damaged birth certificate.

FeesEdit

Service for issuing birth certificate is free
If the old certificate is not presented, the loss or damage shall be sanctioned by a fine between 100-200 lei.

The Civil Status Service issues, upon request, multilingual extracts from birth records. These are documents which have the same evidential value as civil status certificates and are used by holders and persons entitled to foreign authorities in States Parties to Convention No.16 of the International Commission on Civil Status signed in Vienna on 8 September 1976, which Romania joined in 2012 (Law 65/2012).

Legal basis for issuing multilingual extracts of civil status documents on birth

Law no.65 of April 20, 2012 for the Accession of Romania to the Convention No. 16 of the International Civil Status Committee on the Issue of Multilingual Extracts of Civil Status Documents, signed in Vienna on 8 September 1976.

Multilingual extracts of civil status documents issued under Convention No. 16 by the competent authorities of States Parties are recognized without translation, legalization or other equivalent formality and are used under the same conditions as civil status certificates in the territorial scope of the Convention.

States Parties to the Convention No.16

Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Cape Verde, Croatia, Switzerland, France, Germany, Greece, Italy, Luxembourg, Lithuania, Macedonia, Montenegro, Moldova.
Multilingual extracts of civil status documents on birth and / or marriage shall be issued to the holders or their legal representatives.
Multilingual extracts may also be issued to other persons empowered by special proxy.
Romanian citizens domiciled in Romania are legalized, with a view to issuing multilingual excerpts, with the identity document in their term of validity.
Minors aged over 14 who hold or are not an identity card have the right to request and receive multilingual extracts of birth or marriage in their own name, assisted, as appropriate, by one of the parents or guardian who signs application.
Citizens of the Member States of the European Union and of the Swiss Confederation whose civil status documents are registered in Romania shall be legalized, with a view to the issuance of multilingual extracts, with identity documents issued by the states of which they are nationals or with a valid passport.
Romanian citizens residing abroad and aliens whose civil status documents are registered in Romania are legalized in order to issue multilingual excerpts with a valid passport.
Stateless persons whose civil status documents are registered in Romania shall be legalized in order to issue multilingual excerpts with a temporary or long-term residence permit or, as the case may be, with a valid passport issued under the Convention on the Status of Stateless Persons, adopted in New York on September 28, 1954, to which Romania adhered by Law no.362 / 2005.
Upon request, applicants shall be issued with several copies of multilingual extracts completed on the basis of the same civil status document.
