Procedure

• A guardian is a person who is appointed to look after another person or his property…

• Guardianship is required for those who have not completed 18 years of age.
• Guardianship is required for those who are affected with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities.

• Guardianship certificate for disabled people shall be issued by either the district court under the Mental Health Act, or by local level committees set up under the same Act.
• A guardian takes decision on behalf of the minor for protecting the interests of the minor and his property.
  

Apply In-Person:
Applying process in Local Level Committee (LLC) for appointment of guardian to a Person with disability

1. Please use the following link to find your relevant committee:link please select your state, district and click “Search” (keeping “LLC” option) button for relevant list of committee to choose.
2. Please go to the applicable office and get the application form for applying.
3. Please use the following link to download the application online:link
4. Complete the application form with mandatory details.
5. Please submit the completed application (in 2 sets) along with required documents as mentioned in the “Required Documents” section to the receiving authority.
6. Authority will check the submitted application set. If all are in place, the authority will accept the application and give the signed copy of the application as acknowledgement.
7. The Local Level Committee will scrutinize the application and call for any supporting document or information that may be necessary for deciding the issue of guardianship.
8. The sanction of guardianship shall be issued or delivered as per applicable norms.
   

Apply Online through Local Level Committee (LLC) - Get Guardianship Certificate Online with images

2. In the given page please fill in the mandatory details as per the form prompt for “Personal Details”, “Attachments Details”, “Proposed Guardian’s Details” and “Applicant Details” section. Don’t forget to upload the documents at the prompted space as applicable.
3. Please use the appropriate button at the bottom for each section and click “Submit” button at the end to apply online.
4. Please save the acknowledgement for future reference.
5. This application will reach the appropriate committee.
6. The Local Level Committee will scrutinize the application and call for any supporting document or information that may be necessary for deciding the issue of guardianship.
7. The sanction of guardianship shall be issued or delivered as per applicable norms.
   

Apply through District Court

1. Applicant shall approach an advocate to process his application/petition.
2. Please find an Advocate and consult for your requirement.

The applicant will reach a new page. Here please select “Contact Us” option under “About Us” on the left part of the page for detailed contact details.
4. The application with respect to the guardianship of the person shall be made to the District Court having jurisdiction in the place where the minor/applicant ordinarily resides.
5. Please follow the advocate’s guidelines to file the petition for guardianship.
6. If the Court is satisfied that there is ground for proceeding on the application, it shall fix a day for the hearing
7. After hearing of evidence, the court shall make an order.
8. Your lawyer will get the order / it will be delivered as per applicable norms.

Note: If there is a need for clarification, the district court will forward this petition to the respective body/committee for processing before making the order.

Required Documents

• Birth Certificate of the person with disability.
• Residence certificate of the person with disability.
• Disability Certificate.
• In the case of a voluntary organization or institution to be appointed as guardian, the consent of the parents has to be taken on the reverse of the Application Form.
• Reasons for submitting application on additional sheet.
• Particulars of spouse (Application is submitted for appointment of a guardian for a female ward by a male applicant)
• Consent of the persons proposed to be appointed as guardian
  

Note:

• Apart from the above documents authorities at the registration office may ask to submit additional information or documents. Please provide them for processing.
• It is not necessary for the Applicant to submit original documents of proof. Self-Attested Photocopies can be submitted and whenever necessary the Committee can ask for production of the originals for verification.

Eligibility

• Agent must be of legal age and mentally competent to execute such a document.
• Both the parents may jointly apply for guardianship
• In the event of absence of mother / father (due to death, divorce, legal separation, desertion or conviction) the other may singly apply for guardianship of their ward (beyond the age of 18 years).
• In the event of death, desertion, conviction of both the parents, the siblings (including half and step siblings) jointly or singly (reason of single application to be explained separately) may apply for guardianship of a disabled member of the family.
• In the absence of a parent, a relative may make an application for guardianship.
• In the absence of parent and relative, any registered organization may make an application for guardianship.
• The Local Level Committee may direct a registered organization to make an application for guardianship in case of a destitute or abandoned person.
  

Fees

• Advocate fees need to be paid.
• Document preparation charges are the other charges incurred.
• Pay for stamp paper as per requirement
  

Validity

• Guardianship is valid till the death of the person who was appointed as guardian.
• Guardianship is valid till the purpose for which the guardian certificate is granted and is accomplished.
• Guardianship is valid till the guardian certificate is revoked / cancelled

Need for the Document

A guardian certificate grants someone to represent their interests in the legal areas throughout their lives for those persons with autism, cerebral palsy, mental retardation and multiple disabilities are in a special situation as even after they have acquired 18 years of age, they may not always be capable of managing their own lives or taking legal decisions for their own betterment.

Information which might help

• It is not mandatory to apply for legal guardianship of a person with disability.
• Every guardian should furnish to the said appointing authority within a period of three months at the close of every financial year, an account of the property and assets in his charge, the sums received and disbursed on account of the person with disability and the balance remaining with him
• Your original ID is required on the date of registration for verification of authenticity and will be returned on the same day.
