Procedure

Applying process in Poland for citizen and non citizen.

A. Apply in person.

1. Applicant shall apply for Police Clearance Certificate in person with “National Penal Register of the Ministry of Justice” or at one of the information offices of the National Penal Register located in courts throughout the country.

4. Go to the respective office. Application forms can be obtained from the office on visit. Don’t forget to take the required copy of documents along with originals to the office.
5. Please follow as per authorities guidelines and submit the completed application along with documents. Applicant should pay for any charges if required as advised.
6. This application will be processed by respective department.
7. The certificate can be collected from the office where applicant applied in person upon notification or issued as per norms.

Applying process - overseas for citizen and non citizen.

A. Apply through mail(post).

1. Applicant has to apply with the “National Penal Register of the Ministry of Justice” to obtain the PCC through mail(post).
2. Once the application is filled in, please attach the completed application, required document and fee paid details.
3. Mail(post) these set of documents to:

4. This application received will be processed by respective department.
5. The certificate will be delivered to the applicant as per norms.

B. Apply through representative.

1. Applicant shall mandate a authorized representative to apply on their behalf at the respective “National Penal Register of the Ministry of Justice”.

3. The mandated person should be entrusted with the written authorization to apply for it and / or receive it.
4. Representative should carry required documents and the completed application form and go to the respective office.
5. Please follow as per authorities guidelines and submit the completed application along with documents. #Representative should pay for any charges if required as advised.
6. This application will be processed by respective department.
7. The certificate can be collected from the office where applicant applied in person upon notification or issued as per norms.

Eligibility

• Applicant with valid passport and a valid address proof.
• Age: 16 years and above. In case of minors, the application must be submitted by the parent exercising parental authority, if the minor has not turned 16 years.
• The current address of the applicant must be same as in the passport and other supporting documents.
• Applicants who are in need of residential status, employment or long term visa or for immigration to a foreign nation.

Fees

• 50 PLN (Polish Zloty).
• Fee/charge varies for case to case. Updated fee requirement will be provided by respective authorities while applying.

Need for the Document

A police certificate is an official document issued by police or government agency of a country to enumerate any criminal records that the applicant may or may not have. Criminal records may include arrest, conviction, and possibly criminal proceedings.

Information which might help

• As of 27 April 2012 an information about a person from the National Criminal Register provided at the request of a person who is a citizen of a member state of the European Union other than the Republic of Poland includes data contained in the Register as well as data contained in a criminal register of that persons state of citizenship, in accordance with art. 20 s. 1d of the Act of 24 May 2000 on the National Criminal Register.
• Data concerning citizens of Poland who have been validly convicted by a foreign court are deleted from the Register once relevant information about the erasion of conviction is obtained from a competent authority of the relevant foreign state, in accordance with art. 14 s. 8 of the Act of 24 May 2000 on the National Criminal Register.

Others

If the requesting party is a legal person (eg, limited liability company, joint stock company) or a partnership (for example, general partnership, limited partnership), and the query concerns a member of the management or her partner, then the query must be accompanied by a document confirming the fact of such current copy of the NCR, the shareholders' meeting or a resolution of the Supervisory Board to appoint a member of the board, the decision on the appointment, etc.

Persons who have been convicted of a crime must obtain a certified copy of each court record and any prison record, regardless of the fact that he or she may have subsequently benefited from an amnesty, pardon or other act of clemency.

Court records should include complete information regarding the circumstance surrounding the crime of which the applicant was convicted, and the disposition of the case, including sentence or other penalty or fine imposed. All court records, including Polish court records, should be translated into English.
