Procedure

Apply In-Person:

1. To Apply for a Special Exploration Permit or License, the applicant has to approach the Department of Environment and Natural Resources Mines and Geosciences Bureau (MGB) offices link The applicant has click on the region to find nearby offices.
2. An application form will be provided to the applicant by the concerned officer. Or the applicant can download the application form from the following link
3. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
6. Submit all the documents with the completed form to the concerned officer.
7. The applicant has to pay the prescribed fee as requested by the authority.
8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
9. All applications are processed within a reasonable time, having regard to the particular circumstances of each application, including the completeness of information and documents submitted to the authority by the applicant.
10. The authority may seek additional information from an applicant if this is necessary to assess the application. The authority does not need to deal further with an application until the applicant has provided this additional information.
11. The authority will undergo a thorough inspection by a certified inspector to ensure that it meets the required standards.
12. After successful verification the authority will issue the permit
13. This entire process can be completed within 30 days or as per the timeline advised by the respective department authority.

• For corporation/partnership/association/cooperative:
  
  • SEC/CDA-certified Certificate of Registration, Articles of Incorporation/ Partnership/Association and By-Laws; or a Certification from MGB CO/RO concerned that such documents are duly registered in that Office.
  • Location Map/Sketch Plan (1:50,000 NAMRIA topographic map) showing coordinates/boundaries (in tabulated form) with major environmental features/other projects (prepared, sealed and signed by a deputized Geodetic Engineer)
  • Two (2)-Year Exploration Work Program (MGB Form No. 5-4), duly prepared, signed and sealed by a licensed Mining Engineer or Geologist

• Proof of technical competence in the form of:
  • Bio-data and track records in mining operations/ environmental management
  • Sworn statement or employment contract/proof of availed service of the technical person/s who will undertake the implementation of the Work Programs

• Proof of financial capability:
  • Latest audited Financial Statements
  • Annual Report for the preceding year
  • Credit Lines/Bank Guarantees/Deposits
• Proof/s of payment of application fee
• Affidavit of Undertaking (using MGB form)

Eligibility

The following Qualified Person may apply for a Special Exploration Permit or License:

• Individual: a Filipino citizen of legal age and with capacity to contract; or
• Corporation, Partnership, Association or Cooperative: organized or authorized for the purpose of engaging in mining, duly registered in accordance with law, either Filipino or foreign-owned

Fees

• The applicant has to pay the prescribed fee as per the authority request.

Validity

• The permit grants the holder the exclusive right to explore within a specific area for a period of four years, which can be renewed for another four years subject to certain conditions.

• It is important to note that an SEP or SLE does not automatically grant the right to mine. Once a mineral deposit is discovered during exploration, the permit holder must apply for a Mineral Production Sharing Agreement (MPSA) or Financial and Technical Assistance Agreement (FTAA) in order to extract the minerals commercially.
