Procedure

Apply In-Person

1. To apply for transfer of vehicle ownership in Odisha, the applicant has to approach the RTO office of the area.
   
2. Information related to the RTO offices and registering authority can be obtained from the “Office Locations and Contacts” Section of this page.
   
3. You will have to submit Application in front of registering authority within seven days of purchase of vehicle along with the documents.
   
4. The application shall be made in application Form no 29, 30, 31, or 32 to the RTO

Apply Online via National Portal - Odisha Transfer Vehicle Ownership Online with Images

1. To transfer vehicle ownership, the applicant has to visit the official portal of the Ministry of Road Transport & Highways: Link to Portal
2. In the homepage, please scroll down to “Informational Services” and click on the “more” button in the “Citizen Guide” tab.
3. The applicant will be taken to the “Manual” page where all the available services will be listed.
4. Please click on the name of the required service and click on “Step by Step procedure” from the drop down menu.
5. The applicant will be taken to a new PDF page where the process for applying will be explained clearly.

• A person who has purchased vehicle in normal sale, in public auction or transfer of vehicle in case of death of the owner is eligible to apply for transfer of ownership.

Validity

• Incase of non transport vehicles like two wheelers and cars, the registration certificate is valid for 15 years from the date of first registration, and it is renewed after every five subsequent years. Incase of transport vehicles like goods and passenger carriers the registration certificate is valid till certificate of fitness is valid.

Instructions

Transfer of Ownership of Motor Vehicle

1. When the ownership of any motor vehicle is transferred within the same state the transferer shall report the fact of transfer within 14 days of transfer to the concerned registering authority.
   
2. In case of vehicle registered outside the state the transferer (seller) should report the fact of transfer within 45 days of the transfer to the concerned registering authority.
   
3. The transferee (purchaser) shall apply for the transfer to the concerned registering authority within 30 days of purchase.
   
4. In case of death of a registered owner of a motor vehicle or in case of purchase of motor vehicle at a public auction, the successor who has purchased or acquired the motor vehicle should inform within 30 days & for transfer of vehicle in his name to the concerned registering authority within 3 months.
   
   

Causes for transfer of ownership

1. Transfer of ownership on sale / purchase of motor vehicle.
   
2. Transfer of ownership on death of owner of motor vehicle.
   
3. Transfer of ownership of vehicle purchased in public auction.
   
4. Transfer of ownership in the name of financer.
   
   

Transfer of Ownership on Sale / Purchase of Motor Vehicle

1. You need to fill Form 29 (2 copies with seller's sign).
   
2. You need to fill Form 30 (with signature of seller & purchaser & chassis print affixed on it).
   
3. You need to fill Form TCA, TCR (for transport vehicle only).
   
4. You must produce Income tax declaration in form 60/PAN number (except 2 wheeler).
   
5. You must produce NOC (in case vehicle is purchased from other region / other RTO).
   
6. You must produce NOC from entry tax (in case vehicle arriving from out of state whose age is less than 30 months from the date of 1st registration.
   
7. You must produce NOC from financier if any.
   
8. All valid documents of vehicle and required amount of Fee as specified in Rule 81 of the Central Motor Vehicle Rules 1989.
   
   

Transfer of Ownership on Death of Owner of vehicle

1. You need to fill Form 30 (affixed with chassis print on it).
   
2. You need to fill Form 31.
   
3. You need to fill Form TCA, TCR (for transport vehicle only).
   
4. You must produce Death certificate of owner of vehicle.
   
5. You must produce Succession certificate.
   
6. You must produce Affidavit of successor.
   
7. You must produce NOC from the financier if any.
   
8. All valid documents of vehicle and required amount of Fee as specified in Rule 81 of the Central Motor Vehicle Rules 1989.
   
   

Transfer of Ownership of Vehicle Purchased in Public Auction

1. The purchaser should apply for the transfer of ownership within 30 days of taking possession of vehicle at public auction to the concerned registering authority (RTO).
   
2. When vehicle auctioned is without any registration mark or with a registration mark which on verification is found to be false, the registering authority (RTO) assigns new registration mark to the vehicle in name of dept of govt. auctioning the vehicle & thereafter transfer of ownership in the name of person to whom the vehicle is sold is effected.
   
   

Transfer of Ownership in the Name of Financier

1. In case of hire-purchase, lease or hypothecation agreement if the registered owner of the vehicle becomes the defaulter, the financier of the said agreement can apply for the transfer of ownership of vehicle in his own name on following 2 conditions:
   
   • The financier should satisfy the registering authority (RTO) that he has taken the possession of the vehicle from the owner (defaulter).
     
   • The registered owner has refused to deliver the certificate of registration (RC) or has absconded.
     
2. Under such circumstances financier should apply to the registration authority concerned (RTO) for the issue of fresh certificate of registration in form 30 & 36 along with Fees
   
3. The registering authority after receipt of such an application would give the defaulter an opportunity to make any representation by serving him a notice by RPAD at his address entered in the certificate of registration (RC).
   
4. After that the registration authority will cancel the previous certificate & issue a fresh certificate of registration (RC) in the name of financier.

• Whenever a vehicle is sold/purchased it is mandatory on the part of transferor (seller) to intimate the concerned Regional Transport officer by sending form 29 and transferee (buyer) to apply and obtain transfer of ownership within 14 days of the actual transaction. ( Delivery note, sale receipt have no relevance as far as section 50 of motor vehicle act governing transfer of ownership is concerned). Also the intimation on the part of the seller will not facilitate the noting of transfer of ownership in the records. The transaction will recorded in the certificate of registration only when both seller (transferor) and transferee intimate the registering authority.
  
  

Transfer of ownership in case of normal sale

• when a vehicle is sold, the name of the purchaser is noted as the registered owner in place of the previous registered owner and the process is known as transfer of ownership.
  
  

Transfer of ownership on death of owner of the vehicle

• When the registered owner of a vehicle dies, transfer of ownership is affected in favour of the legal heirs of the deceased registered owner. Where the owner ofa motor vehicle dies, the person succeeding to the possession of the vehicle may for a period of three months, use the vehicle as if it has been transferred to him where such person has, within thirty days of the death of the owner informs the registering authority of the occurrence of the death of the owner and of his own intention to use the vehicle.
  
  

Transfer of ownership of vehicle purchased in public auction

• When a vehicle is sold in public auction, the name of the purchaser is noted as the registered owner in place of the previous registered owner and the process is known as transfer of ownership on auction.
