Odisha - Get No Objection Certificate (NOC) for Storage of Compressed Gas

  • Follow the below procedure for grant of “No Objection Certificate – NOC” by the respective district authority for storage of compressed gas for the purpose of sale or trading.
  • The requirement of “NOC” from district authority has been made mandatory for grant of licence for storage of compressed gas in cylinders for the purpose of sale/trading.


Apply In-Person:

  1. In order to apply for “No Objection Certificate – NOC”, the applicant has to approach their concerned office of the District Magistrate / Sub-divisional Magistrate / Deputy Commissioner / Tahsildar / Gram Panchayat within their jurisdiction where the storage land is situated.

Please click “Go” button to get a fresh page and select “Who's who” menu for contact details AND link2 AND Panchayat contact link in the given page please select the hyper link against respective state as per requirement for contact details.
  3. Go to the respective office.
  4. Meet the respective authority at the office. The applicant shall get the advice from the authority to be followed to apply for this certificate.
  5. Collect the application form or write on a plain A4 sheet as advised.
  6. Complete the application form. Attach the entire required document as per our “Required Documents” section in five sets and submit it to the designated receiving authority.
  7. After receiving the application, authorities will check the submitted application and document set. If all are in place the application will be accepted with applicable fees as appropriate.
  8. Authorities will acknowledge the photocopy set and return the same to the applicant.
  9. A register will be maintained manually or electronically using a computer, listing out the date of receipt of each application and each application has to be given a specific number.
  10. Please collect it and please keep it safe for future reference.
  11. This application will be processed further. After internal processing, this application will be forwarded to the respective designated authority for due diligence and ground level verification.
  12. Notification about the progress or requirement of additional details/information will be sent to the applicant through SMS.
  13. Please follow the department’s notification. Applicant gets message about the authority’s visit for site inspection.
  14. On the scheduled date authority’s will visit the site. These authority’s will make verification of the antecedents of the applicant, lawful possession of the site, genuineness of the purpose, interest of the public and any other verifications or enquiries as may be required to be carried out.
  15. On satisfactory grounds a report will be created be generated. This report will be sent back to the issuing authority.
  16. Based on the outcome of the above report along with the recommendation from revenue, fire and other applicable departments and other internal processing the issuing authority will make a decision.
  17. Thus the grant of no objection certificate along with site plan duly signed and sealed by such issuing authority will be made.
  18. The status, viz. Approval or Rejection if any will be conveyed to the applicant through an SMS.
  19. If approved, the certificate will be hand delivered else sent through post to the address mentioned while applying or issued as per applicable norms.


Note:
  • Applicant is required to submit 5 application sets while applying.
  • The district authority shall forward the NOC application to concerned offices i.e. revenue, fire, etc. within a week from the date of receipt of application and concerned offices shall forward their recommendations or otherwise within a period of 15 days.
  • For verification of the interest of the public, the designated authority shall issue a notice to be published calling upon the public to submit objections. If there is any objection rose within a period of one month from the date of publication of the notice, then there will be a hearing for consideration of objections.

EligibilityEdit

  • Applicant should be citizen of India.
  • No person below the age of 18 years shall be eligible to apply.
  • No person who is addicted to intoxication or of unsound mind shall be eligible to apply.
  • Applying firm or enterprise must be a registered organization.
  • Those who satisfy minimum floor area and maximum floor area requirement for a firm as per respective state norms are eligible to apply.
  • Applicant those who are not having any proceedings / cases instituted against them in the CBI, NCB, Enforcement Directorate, Directorate of Revenue Intelligence, Income Tax and Forest Department are eligible to apply.

InstructionsEdit

  • The following guidelines may be followed by the District Authority for issuing “NOC”.
    • The District Authority shall ensure lawful possession of the land/site by the applicant for developing the premises for storage of compressed gas.
    • Public safety, especially with respect to offsite facilities like schools, hospitals, places of assembly in the proximity including accessibility of fire tenders to the site in case of emergency shall be taken into consideration.
    • Any other matter pertaining to public safety shall also be considered.
    • A decision on an application for NOC should be taken within one month.
  • Statutory Warning: Mishandling and misuse of explosives shall constitute a serious criminal offence under the law.
  • Please follow the guidelines fixed by your state for size of the premises and zones meant for starting these establishments for which the certificate is required.
  • There will be a sudden check by the respective licensing agencies.
  • Do not submit fake documents as a proof to obtain this certificate.
  • Incomplete application will be rejected.
  • Avoid spelling mistakes while filling the application form.
  • In the event of any information provided by the applicant while applying for this certificate is being found false or incorrect or ineligible before or after the issue of this certificate, then the certificate is liable to be cancelled and the applicant shall be liable to such further action as may be provided under the law.

  • No Objection Certificate (NOC) is one of the mandatory documents in order to apply for compressed gas related licence.
  • Since “The Petroleum and Explosives Safety Organization (PESO)” does not have any mechanism to verify the details regarding lawful possession of land and various aspects of public safety / safety hazards, it was considered necessary to include specific provision of NOC from District Authority for the purpose of grant of licence for LPG godown (storage).
