Niue - Police Clearance Certificate (Criminal Record)

If you are an individual and you want a copy of your own criminal record, you need to:

  • Complete the Request by individual for a copy of any criminal convictions (Priv/F1) form. You will need to print and sign it.
  • Attach a copy of your valid drivers licence OR passport showing a current signature for verification purposes. Do not send original identification. If you do not have a valid drivers' licence or passport, you will need to ask someone to confirm your identity, using Section 2 of the form. Note: Parents or caregivers completing the form on behalf of children aged 16 and under must provide a signed copy of their own passport or drivers licence and include this with the childs' application.
  • If your application is for a visa to travel overseas or apply for citizenship in another country, please attach a coversheet stating you will require the result to be on original letterhead with ink signature. Note: This is NOT required for Australia.
  • Send your completed form and copy of identification. You can either:
    • Scan and email them
    • Fax them
    • Post them to the Criminal Records Unit.

Follow the steps below if you are a third party (e.g. an employer or insurance agency) seeking a persons authorisation to view their criminal record.

  • Print the Request by third party for a copy of an individuals criminal convictions (Priv/F2) form. It needs to be completed and signed by both the subject (the person whose criminal record is being requested) and the third party they are authorising to view their record.
  • Attach a copy of the subjects valid drivers licence OR passport. Do not send original identification. If they do not have a drivers licence or passport, they will need to ask someone to confirm their identity, using Section 4 of the form.
  • Post the completed form and copy of identification to the Criminal Records Unit.


Apply In-Person:

  1. To Obtain a Police Clearance Certificate, the applicant has to approach the Ministry of Justice – link
  2. An application form will be provided to the applicant by the concerned officer.
  3. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
  4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  6. Submit all the documents with the completed form to the concerned officer.
  7. The fee for this clearance certificate has to be paid as per the authority’s request.
  8. After receiving the application, the concerned authority will check the submitted application and document set. #If all are in place, the application will be accepted.
  9. An acknowledgment receipt will be provided. Please save it for future reference.
  10. Also, set the fingerprint in the request paper from the police office.
  11. Then the application will be processed further. All the updates on the application status will be sent via SMS to the applicant’s mobile number.
  12. Once the process gets completed, the applicant gets a call from the office regarding the application.
  13. The applicant has to visit the office to get the clearance certificate.
  14. This entire process can be completed within 20 days or as per the timeline advised by the respective department authority.

InstructionsEdit

The Ministry of Justice is frequently asked to provide a 'Police Clearance' or a 'Police Certificate' for persons who wish to apply for residence in a foreign country. In New Zealand, there is no such document. The Ministry of Justice is only able to provide a record of your criminal history . The application and associated letters and reports will be disposed of three months after processing the response.

If you wish to access any other personal information held about you by the Ministry of Justice, please write separately to the Criminal Records Officer, Ministry of Justice, giving details of the information you wish to have access to.

Need for the DocumentEdit

The Ministry of Justice can provide a copy of your criminal record to you and/or a person or agency that you authorize.

Your record lists criminal and traffic convictions and sentencing from court appearances. It does not include Youth Court charges.

Niue is a self-governing country in free association with New Zealand. A coral island of only 260 square kilometres, Niue is located about 480 kilometres east of Tonga and 560 kilometres south-east of Samoa.



Information which might helpEdit

If you do not have a driver license or passport ask someone who can confirm your identity to fill in the section. The person who identifies you must:

  • Have known you for more than 12 months
  • Be aged 18 years or over
  • Have a day time phone number
  • Not be a relative
  • Not live at the same address
  • Be contactable during normal business hours.

If you are unable to get someone to complete Section 2, you must complete a statutory declaration. The relevant form can be obtained from your local District Court or by contacting the Criminal Records Unit.



Other uses of the Document/CertificateEdit

Applicants for visas must be of good character. You may have to supply a police certificate (or similar) as evidence of good character, depending on which category you apply under.

Police certificates must be less than six months old when the application is lodged.

OthersEdit

Important: Clean slate records

If you meet all criteria under the Criminal Records (Clean Slate) Act your convictions will not be shown on your record, unless:

  • your record is for your own personal use, AND
  • you tick the box on the form requesting a full record.

It is against the law for most third parties to request or require that you disclose your full criminal record.

In specific circumstances, approved users can ask a person to provide a complete copy of their criminal record for example, if that person is applying to be a foster parent or a Justice of the Peace.
