Procedure

Apply In-Person

1. To apply for Certificate of Patent Design Registration in person, the applicant has to visit the Trademarks, Patents and Designs Registry of the Ministry of Industry, Trade and Investments.

3. Visit the office and obtain an application form to be completed for obtaining a Certificate of Patent Design Registration from the relevant department.
4. Complete the application form with appropriate information under relevant sections. Attest it with your signature once completed.
5. Once completed filling the application form, make sure that you attached all the documents listed in the “Required documents” section of this page.
6. Then, submit it in person to the relevant authority at the office. Make the stipulated payment as directed by the officials.
7. After submission, the application and other documents will be forwarded for examination and verification processes.
8. Once the verification and validation processes are over, the application will be approved and the officials will proceed to take required steps to issue the Certificate.
9. When the document is ready to be collected, the applicant will be notified by the office and the applicant can collect it by any applicable means.

1. To apply for Certificate of Patent Design Registration online, the applicant has to visit the online portal of IPO Nigeria by clicking the following link: Link
2. Visit the link and click “Login” button on the top right corner, then enter the user details in the applicable fields and click “Login” button to proceed.
3. Else, make a new registration by clicking the “Register” button. Registration page will be opened, enter all the details asked, check the ‘Terms & Conditions’ box and click “Register” button.
4. Complete the registration by following the on-screen instructions and proceed to enter into the portal.
5. After logging in, locate the application for the grant of Registration Certificate of a Patent or a Design as applicable and make a click on it.
6. Application form will be opened. Complete the form as applicable to your requirement and relevant information.
7. Upload all the required documents by clicking the applicable buttons and following the directions available.
8. Make the payment as applicable by using the available options. Once completed with all the processes, submit the application by clicking ‘Submit’ button.
9. After submission, the application and other documents will be forwarded for examination and verification processes.
10. Once the verification and validation processes are over, the application will be approved and the officials will proceed to take required steps to issue the Certificate.
11. When the document is ready to be collected, the applicant will be notified by the office and the applicant can collect it by any applicable means.

Eligibility

• Any true inventor who wants to get his/her patent or design to be registered officially can apply.
• An authorised representative or agent is eligible to apply on the inventor’s behalf.
• Anything that wants to be patented must be dedicated for any new invention which can also be used in trade and industry.
• A design to be registered should be new and original, beauty is in its shape, configuration or ornamentation and able to be produced by an industrial process.

Validity

• Patent registration: 20 years (subject to annual fees)
  
• Design registration: 15 years (subject to renewal in every 5 years)
