  • In discharge of its responsibilities for regulating air transportation and ensuring safety of aircraft operations, NCCA has laid down detailed rules, regulations and procedures under the provisions of Aircraft Act.
  • The applicant is required to submit the complete application to the NCCA together with the fees and relevant documents to support the intended operation.
  • Application for the grant of an Airline Operating Permit should be made in writing to the Authority and should contain such information as specified in the regulations or such other information as may be published by the Authority from time to time.
  • The authority to grant the permission has been delegated by the government of Nigeria to NCCA which is granted in the form of an Air Operator Permit (AOP).
  • An operator is required and expected to ensure that all operations undertaken are well within the requirements specified in the Airline Operating Permit.
  • The NCCA will then make a formal assessment of the completeness of the applicants proposal and invite the applicant for a Formal Application meeting where the details relating to the certification process would be formally discussed.
  • NCCA officials will undertake a detailed study of the applicants manuals and other documents, which accompanied the formal application.
  • The documentation must be complete,accurate and current to satisfy the NCCAs requirements before the inspection phase can commence.
  • There will be series of discussions between the NCCA and the nominated post holders of the applicant at this stage in regard to establishing the validity/acceptability of the applicants proposals
  • It should be noted that the documents shall reflect precisely the mode and manner in which the applicant intends conducting the proposed operations and once approved, they shall form a part of the understanding between the NCCA and the operator in regard to future functioning of the operator.
  • The holder of a permit granted by the Authority under the regulation shall at all time begin a position to demonstrate the ability to meet the conditions as set forth in the Airline Operating Permit.
  • The issue of an Airline Operator Permit would be dependent upon the applicant demonstrating an adequate organization, method of control and supervision of flight operations, training programmes as well as ground handling and maintenance arrangements consistent with the nature and extent of the operation specified.
  • The certification team of Inspectors of NCCA is responsible for conducting the required evaluations to ensure the applicants capability of meeting the actual and potential obligations in establishing and continuing to maintain safe operation of air services, prior to issuance of the AOP. Hence, all Inspectors involved in the certification process of the issuance of an AOP, shall be guided by the requirements stipulated in Aircraft manual.

  1. A copy of the Certificate of Incorporation of the company;
  2. A copy of the Memorandum and Articles of Association of the company with minimum share capital of Five Hundred Million Naira(N500, 000,000.00);
  3. Copies of Tax Clearance Certificates of the company and of each of the Directors for the last three years;
  4. Company exposition detailing the ownership and management structure, applicants experience in the area of the proposed services it intends to provide, name and experience of technical partners (if any) etc;
  5. Comprehensive details of technical partner including name, address, experience, nature of partnership arrangements etc. Documentary evidence should be provided;
  6. A copy of a detailed Business Plan on the operation indicating

EligibilityEdit

It is eligible for citizens/residents of Nigeria engaging in Air transport Business.

A citizen of Nigeria,
An individual citizen of another State who is lawfully admitted for permanent residence in Nigeria,
A corporation lawfully organised and doing business under the laws of Nigeria and the aircraft is based and primarily used in Nigeria,
A government entity of Nigeria or political subdivision thereof; or
A foreign person who has leased the aircraft to one of the persons described in paragraphs (i) (iv) above, provided that:



FeesEdit

  • The law requires that permitting authorities charge sources annual fees that are sufficient to cover the permit program costs. Fees are structured so that sources that emit more air pollution pay more for their Title than sources that emit less.
  • In addition to fees charged by permitting authorities, some sources may choose to hire consultants to help them prepare their permit applications and assist them throughout the permitting process.


ValidityEdit

An Airline Operating Permit is valid for a period of three (3) years and subject to renewal every 3years on such terms and conditions as may be specified by the authority from time to time.

Processing TimeEdit

  • The amount of time it takes to get a permit varies according to many factors, including what type of permit it is, its complexity, who the permitting authority is, how controversial the project is, and whether the permit is appealed after issuance.
  • A New Source Review permit issued by NCCA takes between six months and one year. The time frame for permits issued by NCCA pollution control agencies varies, and is often specified in local regulations. In Nigeria, Federal state law requires agencies to issue NCCA permits within 180 days.

InstructionsEdit

  • The applicant is required to appear in Person.
  • The holder of an Air Operating Permit is required to file with the Authority, a true copy of every contract or agreement affecting air transportation or any modification or cancellation thereof, between the air carrier and any other air carrier or other bodies.
  • The Authority may disapprove of such contract or agreement whether or not previously approved if found to be in violation of these regulations, rules and orders made by the Authority or against public interest.

The application letter for the Permit must contain the following particulars:

  • (a) Name and address of applicant;
  • (b) The type of ground handling services to be provided;
  • (c) Proposed airport or airports where applicant intends to provide the service(s);



Need for the DocumentEdit

In accordance with the provisions of the Aircraft Rules in Nigeria, No person of any category can use any aircraft in Nigeria for hire and reward in public transport category to provide non-scheduled or charter air service unless such a person holds an Airline Operating Permit (AOP)issued by the Authority.

Further,the Aircraft Rules, stipulates that no air transport service, other than a scheduled air transport service, shall be operated by a Nigerian air transport undertaking unless it holds a Non-Scheduled Operators Permit granted by the Federal Government of Nigeria, based on the Applicants intended service, The Applicant would be required to comply with the related regulations before an Air Operator Permit is issued by the Authority.

Usually, the permit is issued by the Nigerian Federal state or Nigerian Civil Aviation Authority,the agency responsible for the Air craft operations in Nigeria. In most cases, NCCA is the permitting Authority.
