Following are procedures on how you can apply for a Food Premises Licence in New Brunswick, Canada. Applications may be submitted online or in person.

Apply OnlineEdit

  1. You can submit your application online. To do this click this - LINK.
  2. On the next page you will be asked to choose the region where your business is located: South, East, Central, or North Region. Just click the appropriate region to move on to the next page.
  3. Next, you will be asked to complete an application form.
  4. Once you are done with the form click the "Add to Basket" button.
  5. You will then need to submit your requirements to the Public Health or Agri-Foods Inspector. If you have any question regarding your application you can call their office (contact numbers provided under "Office Locations & Contacts" section). Note: Your file will not be complete until all of the mandatory attachments have been submitted to the Health Protection Branch office.
  6. Pay the licence fee.
  7. Once your application is approved you will receive your licence.

Apply In-PersonEdit

  1. If you are thinking of applying in person you can download the Food Premises Licence Application Form using the link provided under 'Documents to Use' section.
  2. Bring the completed form to any Health Protection regional office.
  3. Submit all the required documents.
  4. Pay the application fee. Initial (new) application fees are now prorated check out the 'Fees' section to know more.
  5. Once your application is approved you will receive your licence.

Required DocumentsEdit

  • Completed application form
  • A Floor Plan of the food premises showing location of equipment and process flow patterns, if applicable.
  • The dates and times of intended operation for the food premises (locations are to be indicated if a temporary event or mobile canteen/cart).
  • Copies of Menus to be used - if applicable.
  • Statement of the applicant’s experience in operating a food premises or other documentation indicating that the applicant has sufficient knowledge or training to operate the food premises in a safe manner.
  • If the premises has a private water supply, a water test result.
  • Details of staff training that has been or will be provided.
  • Details of Hygienic practices and procedures to be followed by persons working in the food premises and a copy of the applicant’s health policy for staff.
  • Documentation detailing how the premises, equipment and utensils will be kept clean and sanitary, including details on disposal of waste products.
  • If a non-profit organization, evidence to support that status.
  • If the premises is serviced by a private sewage disposal system, indicate the type of sewage disposal system, total number of seats in the food premises, and the total number of staff working on each shift.
  • For Classes 4 and 5 (see classes discussed under 'Instructions' section), documentation on food handling procedures used by the applicant for potentially hazardous food. This should include thawing methods (if applicable), cooking and holding temperatures, cooling methods, etc.. Sufficient information must be provided to allow for a risk assessment of the process by the PHI.
  • For Class 4, proof of food handler training and certification to satisfy the following: at least one person present at all times in the area of a food premises where food is being prepared and the manager of the food premises must hold a certificate confirming their successful completion of a food handling program as per Section 39(1)(2) of the Food Premises Regulation.
  • For abattoirs, species slaughtered.
  • Any other documents the Minister will require to assess your application.

ValidityEdit

  • Licences are valid until March 31st of each year. Licences may be renewed online or you may also go to any Service New Brunswick location to file for renewal.
  • The licence is non-transferable. When there is a change of operator, a new application must be submitted with all above attachments re-submitted for the file. If the licence is for a new construction, you will also need to contact your local Planning Commission Office

InstructionsEdit

Licences to operate food premises are issued by the Regional Directors of the Health Protection Branch. A licence will be issued to an applicant who has completed an application for a licence, submitted all the required documents, paid the required fee and has demonstrated compliance with the Public Health Act and its regulations.

There are three types of food licence class, the class is determined by the type of food prepared and sold, and the way foods are handled. Each of these premises must be licensed to operate in New Brunswick and is subject to inspection by Public Health or Agri-food Inspectors.

Classes:

  • Class 3: Premises where potentially hazardous food is stored, handled, displayed, distributed, sold or offered for sale without any processing or preparing on the premises
    • Examples of Potentially Hazardous Foods: Meat and meat products; fish, shellfish and seafood products; Poultry; Eggs; Cream-filled pastries and pies; Cut fruits and vegetables
  • Class 4: Premises where food is prepared or processed without any killing, pasteurizing, or, if meat or fish, without thermal processing, for sale or consumption on or off the premises, but is not distributed wholesale.
  • Class 5: Premises where food is processed for direct sale or wholesale distribution or where food is prepared for wholesale distribution and including an abattoir. This includes maple syrup producers.

Not-for-profit organizations may operate under a Class 3 or 4 licence. Temporary events, whether not-for-profit or otherwise, may be operated under either a Class 3 or 4 licence.

Need for the DocumentEdit

Individuals operating a food premises without a licence are subject to charges under the Public Health Act.

Information which might helpEdit

After issuance of the licence, operators must be aware that one to three routine annual inspections will be conducted. How many times will a premise will be conducted will depend on the types of food served, staff training, maintenance and historical compliance of the premises. Inspections are not scheduled. Violations of the regulations generally result in additional follow-up compliance inspections but may also result in licence revocation if the violation(s) pose(s) an immediate risk to public health.
