Mozambique - Apply for a Divorce
ProcedureEdit
1.Start by identifying either a nearby Tribunal Supremo (if divorce is a contested divorce) or nearby conservatory for civil marriage / divorce (if divorce is by mutual consent), write an application for divorce and submit it to court or to registrar at a conservatory for civil marriage;
2.When you submit the application to court, the other party is also submitted with the court petition;
- When documents are received by court, they are reviewed and if found necessary, a case hearing date is set. During the court hearing, decision shall be made to either grant divorce or not;
- If divorce is granted, then you take the divorce decree for registration at a nearby conservatory for civil marriage / divorce for registration;
- The divorce is then registered in the marriage register on the same page and line where marriage was previously registered;
3.When application for divorce is submitted to the conservatory for civil marriage / divorce, the documents are examined to assess eligibility of applicant;
- If proved necessary, divorce is granted to and recorded in marriage register on the same page and line where marriage was previously registered;

Divorce is the process of terminating marriage that existed between two parties based on an order made by authority upon request by either one party against the other or by both parties after reaching an agreement. In Mozambique, a divorce order may be granted by court or by conservatories of civil status.
