Mexico - Obtain a Divorce Certificate

A divorce certificate is a document that verifies the dissolution of the marriage contract between a man and a woman.

How to apply

  1. Visit the civil registry office (Registro Civil) where the marriage was official registered and recorded with all the required documents.
  2. Fill in the petition form correctly pay the required fees and (if applicable) authorize a researcher and/or attorney to receive a copy of the divorce decree request form in Spanish (PDF 61KB) Included in the document, there's an informal English translation of the request.NB this is for information only and should not be submitted.
  3. Civil Registry Officer (titles may include: Official, Coordinador General, Director, or Jefe de Archivo Estatal Del Registro Civil) will then verify and process your documents.
  4. If all the information is correct the state will issue you a divorce certificate with an official Seal and signature from Registro Civil within seven working days.

To obtain a divorce in Mexico, you must be a resident of Mexico. Usually this process takes several months and you must reside here for at least 6 months before applying for the divorce. You may wish to retain an attorney in Mexico with experience in divorce proceedings


The fee for a Mexican Divorce is: $995.00


Your divorce will be valid and recognized everywhere in the world. Under a policy known as comity countries recognize the laws of other countries.

The divorce process in Mexico takes three to six months to complete depending on the details of the case.

The Mexican General Population Act (Ley General de Poblacin), which is a federal law and thus supreme in all states, literally provides that no judicial or administrative authority may hear a divorce action involving non-Mexicans unless the corresponding petition for dissolution of marriage is filed together with a certificate issued by Mexicos Department of State, certifying the plaintiffs legal residency in Mexico and that the plaintiffs immigration status allows the filing. The Regulations of the Mexican General Population Act (Reglamento de la Ley General de Poblacin), which explain and expand the provisions of the Mexican General Population Act, further provide that a Divorce Permit shall be granted only if the marital domicile was established in Mexico.

Need for the Document[edit]

Divorce proceedings in Mexico fall under local State law and while the requirements are generally the same in all 31 states and the Federal District of the Republic, there could be some slight variations depending on the State. Therefore, it is strongly advised that you directly contact the local "Registro Civil" of the city where you intend to hold the ceremony in order to obtain complete information (there are "Oficinas del Registro Civil" in each city in Mexico). For those staying at a hotel, the management can provide you with the address of the nearest Registro Civil.

Information which might help[edit]

Presentation of the family court’s decree for registration of this document at the Civil Registry.  Exception, if the married couple is over the age of 18 years old, childless, and is in mutual agreement to divorce, they may file for an administrative divorce at the Civil Registry and no family court decree is necessary.

Other uses of the Document/Certificate[edit]

  • Apply to remarry, or otherwise have to show proof that you are divorced, you may be asked to show the Certificate.
  • Changing of name.i.e if the wife had change her name to that for her ex husband

Federal District



  1. If spouses get divorced outside of Mexico they must present documents that confirm the divorce under the provisions of the Civil Procedure Code in order to consider them to be divorced in the Federal District and recorded in the Civil Registry.
  2. The general immigration law and its regulations prevent the judicial and administrative authorities from invalidating a marriage where foreigners are involved, unless a government authorisation is given and their immigration status allows for the proceeding to invalidate. Authorisation is not required when the plaintiff is Mexican.
  3. The applicable law to nullify a marriage that took place abroad is the law where the marriage was held, which the Mexican judge will review and resolve accordingly. Once the marriage is nullified, the judge must follow all the necessary procedures in order to record this act in the Civil Registry.
