Apply In-Person

  1. Residential lease disputed are file at the civil courts, while commercial lease dispute are file at the commercial court, building owners/lessor aggrieved by the lease agreement contract should visit the court responsible/competent and file the application.
  2. Head to the competent court and express your aggrieves at the front desk staff, Collect necessary forms and accurately fill them, attach all the required documents (listed below under required documents section) and submit the application file to be verified and recorded court clerk/court receptionist.
  3. The file is submitted to the court, department responsible where it is verified and registered, you will then be advice to make payment of the required fees as determined by the court at the cash counter.
  4. Upon making the payment an interim court order in the matters of residential lease will be drawn up at the civil court and in the case of commercial lease a court order judgment will be drawn up at the commercial court by the authorized official.
  5. If the applicant summons the bailiff, the bailiff will accompany the applicant to the building leased, who will effect the eviction notice.

EligibilityEdit

Owner/lessor of a building either leased as residential or commercial, can evict a tenant in the following circumstances;

  • When the fixed-term contract has expired.
  • When the lease contract is for an indefinite period if the lessor requests it after 6 months' notice by extrajudicial means.
  • In the event of non-payment of rent in arrears.
  • In the event that the lessor wishes to take over the premises for personal or family use. In this case, the latter must obligatorily serve a leave (notice) of 6 months to the tenant and occupy the premises for two years on pain of payment of damages to the evicted tenant.
  • In the event of major works affecting the foundations and walls of the building.


FeesEdit

  • 8,000 CFA francs for enlistment before the civil courts
  • 26,000 CFA francs before the commercial court.

NB: not including are the costs of bailiffs for the summons and the lawyers' fees, if applicable

The eviction notice state the date and time, which the eviction should be carried out.
