Malawi - Register Customary and Public Land in Districts

Apply In-Person

  1. After the land has been allocated to by a chief (if customary land) or by government agencies lands or by district commissioner (if public land),
  2. Visit the Ministry of Lands, Housing and Urban Development office department of land to obtain the application form and other forms to be filled as advised by the authority, i.e. Customary land consultation chief’s form in case of customary land, agricultural lease application form if the land is to be used for agricultural purpose and land application forms in case of public land
  3. Complete the application form with all the relevant requested documents and submit them to the reginal commissioner including the plot sketch or Map.
  4. The Regional Commissioner will then consult the Town and Planning Committee by submitting the plots map to the committee for vetting and approval
  5. The Town and Planning committee will vet the plan and if they approve it, they will deploy a memorandum to the minister to approve the lease application
  6. Once approved , the land department will conduct a cadastral survey through the Survey’s department
  7. Bases on the results of the survey, lease documents will be prepared in triplicate , which will be signed and stamped by all parties involved including you
  8. Then the land department will register the title deed and issue it to you.
  9. You as the lessee, will pay the ground rents annual according to the lease agreement.

InstructionsEdit

  • Land designated for investment purposes shall be identified, published in the Gazette and allocated to the Malawi Investment and Trade Centre which shall create derivative rights to investors in accordance with the Investment and Export Promotion Act, 2012.
  • The size of land allocated to investors shall be in accordance with the ceilings which may be set by the minister responsible for lands in consultation with minister responsible for investments, based on the type of activity and location of land.
  • Non-Malawian investors can be granted lease of land with a maximum period of 50 years, while for Malawians it is 99 years.
  • Sale of leased land to a non-Malawian shall be done if the sale of land is published in a newspaper in daily circulation not less than 21 days before the date of sale, specifying price, location and size of the private land, and developments on the land. Sale of the advertised land shall be made if no Malawian is able to purchase the said land at the advertised price or higher.
  • Non-Malawians shall not exchange title of land amongst themselves by way of gift.
