Maharashtra - Apply Vehicle Permit for Disabled Students

Apply In-Person:
- The applicant shall first retrofit the vehicle through the right vendor who will design the vehicle as an “Invalid Carriage”/”Adapted Vehicle”.
- Get 50% disability insurance discount on purchase and get the car upgraded by reputable companies.
- Now, find the nearest RTO in the link provided Link and visit there with all the “Required Documents”.
- The applicant shall also bring FORM 20 and fill it up correctly with the vehicle's class listed as Invalid #Carriage and submit it to the concerned authority.
- The appointed inspector will inspect and approve the vehicle at the RTO.
- Once the paperwork is successfully done, the applicant will be asked to return in a week to collect the RC.
- On successful verification and mandatory proceedings, the applicant will receive their vehicle permit.
NOTE:
- The applicant must be a registered owner of a transport vehicle to apply for the permit.
- The nature of disability should be referred to as permanent and above 40%. It must be issued by the competent authority.
- To fit the need of a physically challenged person, the Motor Vehicles Act,1988 makes the alteration of vehicles mandatory.
- The altered vehicle must be registered in the name of the disabled person and must be used by him/her only.
- The applicant should confirm with the RTO as well as from the dealer about his/her trade license and the process of concession before applying.
- The applicant must produce Payment Receipts/Confirmation Page/ID Proof/Disability Certificate, if asked for, in the RTO while collecting the permit.
Required DocumentsEdit
- Medical Certificate duly signed and countersigned in the prescribed format (Annexure B) by a medical practitioner, Government of India, clearly mentioning the percentage of damage and the form of disability in the applicant.
- Disability Certificate issued by a Medical Board of three members duly constituted by the Central or State Government, out of which, at least one member shall be a specialist in the required department of Medical Science.
- The applicant must ensure to have a Disability Certificate/UDID Card.
- GST Certificate (for a concession on PwD)- a copy of Income Tax Return filed for the last three years.
- Chassis Number Print.
- Proof of Date of Birth.
- Registration Certificate (RC) of the Vehicle (FORM 20).
- Address Proof of the Disabled Person.
- ID Proof of the Disabled applicant (Aadhaar Card, UDID Card, PAN Card or Voter ID).
- Two recent passport-sized photographs of the applicant.
- Fitness Certificate of the vehicle (FC).
- Insurance Certificate of the vehicle.
- Fees for the permit.
- Demand drafts that were drawn in favour of the Authorities prescribed in respect of other states towards payment of composite taxes.

- Affidavit from the applicant - a self-declaration stating that he/she has not availed this concession in the last five years and she/he will not dispose of the vehicle after availing the GST concession for 5 years from the date of purchase in prescribed format placed at Annexure C.

EligibilityEdit
- The applicant must be a disabled Indian student who is 18 or above years of age, can apply for a permit of any category of the vehicle of his/her preference.
- In the case of SC/ST/OBC with a disability, the applicant must have a Tribal Certificate.
- The owner must be a person belonging to the PwD category.
- The motor vehicle shall be adapted as per the disability of the person.
- Should be a registered owner of a vehicle, who is now eligible to retrofit or alter their vehicle with the verification granted by the manufacturer.
- The age of the vehicle should not exceed more than 12-15 years old.

Need for the DocumentEdit
- These permits are granted to owners who are differently able and have modified their vehicle to an Adapted vehicle as per the Motor Vehicle Act, 1988.
- Permit (for the Differently abled candidate) is needed for a vehicle operator to travel from one place to another.
- The motor vehicle is adapted as per the requirement of the applicant. The permit shall mention the number of passengers to be allowed in the vehicle.
- According to the current details under the Central Motor Vehicles Rules (CMVR ) 1989, the ownership type does not indicate the details of the disabled candidate. It becomes tough for such disabled students to avail themselves of several benefits under government schemes like the benefits to PwD as per scheme for financial purposes of the Department of Heavy Industries. This procedure is needed for Pwd to avail of the benefits of PwD schemes facilitated by the Government of India, for a vehicle permit.

- For Disability Certificate: Any person with a specified disability may apply in Form IV/20 for a certificate of disability and submit the same to a competent medical authority. - Article 15 (2) States that no citizen (including the disabled) shall be subjected to any disability, liability, restriction or condition in the matter of their access to shops, public restaurants, hotels and places of public entertainment or in the use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of government funds or dedicated to the use of the general public. Women and children and those belonging to any socially and educationally backward classes or the Scheduled Castes & Tribes can be given the benefit of special laws or special provisions made by the State.
- As per the Motor Vehicles Bill (2019) guidelines, a differently-abled person is required to pass both the written and the practical tests to obtain a driver's licence.
- Must have a FASTag, a handicapped applicant who falls under the FASTag exemption can get the free FASTag from any of the FASTag issuing banks by presenting substantial documents as proof.
- For authorisation of Permit: The applicant should mention the correct details (email id, mobile number and Aadhaar Number of the dealer & RTO) in the application. No modifications in any respect (Vehicle model/dealer/ RTO) will be made to the certificate once issued.
- To fill up FORM 46 & FORM 48: Mention personal details (Name & complete Address, State, Zip Code of the applicant), Vehicle Details (Registration mark of the motor vehicle, Year of manufacture, Engine number or motor number in case of battery-operated Vehicles, Chassis number of the vehicle, Permit number of the motor vehicle, Date of expiry of the permit, Gross weight of the motor vehicle, Unladen weight of the motor vehicle, Name of the permit-issuing authority, Seating capacity of the vehicle, Period of validity of the authorization), Government ID details (Aadhaar No./ Tribal ID No. (for SC/ST)/PAN Card and so on), medical details (UDID Number, Professional License No.of the Physician, email ID & Phone Number of the Physician) in the application form.

Goods Carrier permits:
- Permits that are originally issued by one state and later on approved in another state by the concerned State or Regional Transport Authority under section 88 of Motor Vehicle Act, 1988.
National Permits :
- National permits are issued for goods vehicles to facilitate them to go outside the home state.
- National Permit is issued for a minimum of four simultaneous states (including the home state) under rules 86 & 87 of Central Motor Vehicles Rules, 1989.
- For obtaining a vehicle permit the maximum age of a particular vehicle should not exceed 12 years. However, the maximum age in the case of a multi-axle vehicle should not exceed 15 years.
- For the issue of National Permit, the applicant has to apply on forms 46 and 48 along with other documents and complete the necessary formalities at the RTO.
Permits for Passenger Vehicles:
- Auto Rickshaw and Taxi permits: These permits are administered by MLO (AR) Burari for carrying passengers to various places within a state. Fare is charged as per the fare meter mounted on such Vehicles & as determined by STA.
- Prevailing fares are as under:
- Auto-Rickshaw- Rs.8.00 for the first kilometre and thereafter Rs.3.50 for every additional kilometre.
- Taxi- Rs.10.00 for the first kilometre and thereafter Rs.5.00 for every additional kilometre.
- Maxicabs:
- Such permits are issued by STA to vehicles carrying passengers to various parts of the State on a fixed route and as per the fare fixed by the STA. The total seating capacity of such vehicles should not exceed more than 12 excluding the Driver.
- Eco-Friendly Sewa:
- Transport Department has issued permits to battery operated 3 wheeled vehicles having seating capacity up to 10.
- Rent-a-Cab Permits :
- Rent-A-Cab scheme was launched in India in 1989. Under this scheme, the passenger drives the vehicle himself & fare is charged on no. of days the cab is used. The permit of these schemes is also valid throughout India provided the passenger taxes were paid to the corresponding states.
- All India Tourist Permit (AITP):
- A tourist permit shall be invalid from the date on which the motor vehicle completes 9 years in the case of Motor Cab and 8 years where the motor vehicle is other than a motor cab, unless the motor vehicle is replaced by another, the latter vehicle shall not be more than 2 years old on the date of such replacement. The seating layout shall be two and two or one and two or one and one on either side, all seats facing forwards. The Vehicles should also have other facilities like a public address system, drinking water, push full back seats, fans, curtains, a separate driver cabin etc. The applicant has to apply on forms 45 & 48 along with other formalities.
- For retro fitment/ modifying a vehicle to an Adapted vehicle, the applicant must fill in FORM 22 Link through the manufacturer and avail the benefits of the PwD schemes as per the specifications laid down by the Central Government of India under Section 52 of Motor Vehicles Act, 1988.
- Retro fitment on 2 wheeler for the disabled student: Two-wheeler vehicle can be modified by the fitment of a sidecar on the left side of the vehicle. Ensure that minimum changes are made to the basic structure of the vehicle. In case the original vehicle has any foot controls (such as accelerator brake clutch or gear shift), such controls shall be adapted for operation by hand. The vehicle must have a device to intentionally lock the wheels in order to prevent the rolling of the vehicle. The vehicle must have either a hand start or an electric-starting mechanism. Clamping arrangements shall be given to person’s aids/ crutches etc.
- Fitment of additional two wheels at the rear on both sides:- Two-wheeler vehicles can be altered by fitment of additional two wheels to provide balancing/stability to the vehicle. The additionally fitted wheels must be of the same size and specification as the original rear wheel. While carrying out such a modification, ensure that minimum changes are made to the basic structure of the vehicle. In case an original vehicle has any foot controls (such as accelerator brake clutch or gear shift), such controls shall be modified to perform by hand. The vehicle must be devised to intentionally lock the wheels in order to avoid rolling of the vehicle. The vehicle shall have either a hand start or an electric-starting mechanism. Clamping arrangements shall be provided for carrying aid/crutches etc.
- Once the vehicle is modified to Adapted
- Vehicle and the Chassis Number (VIN/Vehicle Identification Number) has been allotted to the car by the manufacturer, the disabled student may apply for a concession on the GST/excise/road tax concession/exemption available for Persons with Disabilities.
- Concessional rate of GST for motor vehicles for the use of persons with Orthopedic physical disability is notified by the Ministry of Finance vide its notification dated 28th June 2017, amended from time to time.
- For availing of the concessional duty, an eligible applicant with Orthopedic physical Disability must be having a Physical Disability of equal to or greater than 40% disability irrespective of the fact that the applicant drives the vehicle himself or otherwise.
- This concession can be availed for the following motor vehicles of length not exceeding 4000mm only, namely:-
- Petrol, Liquified petroleum gases (LPG) or compressed natural gas (CNG) driven vehicles of engine capacity not exceeding 1200cc;
- Diesel driven vehicles of engine capacity not exceeding 1500 cc
- To avail of vehicle tax exemption/GST/Excise concession, make sure to approach the Department of Heavy Industries. The person must make an application, duly meeting all the eligibility requirements and address it to the Under Secretary (AEI Section), Ministry of Heavy Industries & Public Enterprises, Department of Heavy Industry to attain a concession on the GST certificate. - In order to get an excise duty concession certificate/GST Concession, the applicant is required to submit the following three documents along with an application:- a) Medical Certificate from the Chief Medical Officer (CMO) of a Government Hospital, b) Certificate from the manufacturer of the car that is booked by the applicant, specifically designed for disabled people and c) An affidavit by the applicant, stating that she/he had not benefited from this concession in the last five years and that he will not dispose of the car after possession for at least five years. - Section 45 of “The Persons with Disabilities (Equal Opportunities Protection of rights and Full Participation) Act 1995” states that the Governments and the local authorities shall, within the thresholds of their financial capability and action must provide for the Establishment of auditory signals at red lights in the public roads for the benefit of persons with visual handicaps:
- Causing curb cuts and slopes to be created in pavements for the easy access of wheelchair users;
- Engraving on the surface of the zebra crossing for the blind or persons with low vision.
- Engraving on the edges of railway platforms for the blind or persons with low vision;
- Devising appropriate symbols for disability
- Warning signals at appropriate places.
