ProcedureEdit

1.To apply for a divorce, an applicant start by soliciting a lawyer to help in the divorce process;

2.Together with a lawyer, the applicant prepares divorce papers together with required documents and submits them to the registrar in the ministry of internal affairs. At this stage,

  • The applicant prepares application and submits to the Registrars office
  • The submitted applications are reviewed assed and screened by the registrar. This is done to assess eligibility of applicants;
  • After the screening process, the registrar decides on whether a certificate can be issued or not;

3.If approved, the applicant can now proceed with submitting a petition to the nearby court;

4.When petition is submitted, each copy is sworn to by applicant, signed and stamped by court and a date and time for court hearing is set.

5.Thereafter submit a court of petition to the other partner;

6.When court sits for the case hearing on the set date and time, the applicant through his / her representative (lawyer) is required to prove that the grounds provided in his / her submitted divorce papers are true.

  • For instance applicant may be required to present documents of proof and witnesses or any other proof can be presented to support case;

7.When an applicant proves truthiness of grounds and the judge is satisfied, a Divorce Decree is granted.

8.The decree will end of marriage and therefore a divorce shall be issued certificate is issued;

2.Applicants must ensure that they have sound reasons for wishing for a divorce;

3.The reasons for applying for divorce must be strong enough;

4.Divorce is applied for by only the parties in married this is either husband or wife;

5.Be aware of the effects of divorce before applying;

6.Seek legal advice and counseling before opting for divorce;

7.Children must not be used as weapons in cases of divorce;

8.Several copies of petition should be submitted to court;

9.Endeavor to gather proof and witnesses where necessary;

10.Applicants with imprisonment reasons must prove that partner was proven guilty and sentenced for not less than five years;

Need for the DocumentEdit

Divorce is legal ending of a legal marriage. When divorce occurs a divorce certificate is issued. In Liberia, divorce certificates are issued by the registrar under the Ministry of Internal Affairs.

  • It is important to note that Divorce Certificates and approve of same in Liberia is done by the Legal Affairs Section.
  • The section should through the deputy minister for administration submit quarterly report about divorce occurrences to the Minister of Internal affairs.
