To Transfer Property Due to Death the applicant must obtain a succession certificate. If the deceased left any will the applicant has to obtain probate
- A succession certificate is a document that is issued by the court and confirms that the person named in the will is the rightful heir to the property. This is a necessary step in order to transfer the property ownership to the beneficiary.
- Probate of the will is a legal process that establishes the validity of the will and appoints an executor to carry out its terms. The probate application is filed in the court of the district in which the testator (the person who made the will) was domiciled at the time of their death.
Apply In-Person:
- To Transfer Property Due to Death, the applicant must approach the Sub Registrar office of their respective state link
- An application form will be provided to the applicant by the concerned officer.
- The applicant must fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant must attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the concerned officer.
- The applicant must pay the prescribed fee as requested by the authority.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- All applications are processed within a reasonable time, having regard to the circumstances of each application, including the completeness of information and documents submitted to the authority by the applicant.
- The authority may seek additional information from an applicant if this is necessary to assess the application. The authority does not need to deal further with an application until the applicant has provided this additional information.
- Once the authorities are satisfied with the documentation and verification process, they will issue a mutation order. This order officially transfers the property ownership.
- After receiving the mutation order, update the property records with the new owner's details. This ensures that the property ownership is officially reflected in the records maintained by the government authorities.
- This entire process can be completed within 3 months or as per the timeline advised by the respective department authority.
