Karnataka - Obtain a Legal Heir Certificate (Succession Certificate)

In Karnataka, a legal heir certificate is issued only to the kin of deceased government servants. Everyone else has to obtain the certificate through their jurisdictional civil court. It requires filing a suit before the court while applying for this certificate.

Apply through Online portal

  1. Please visit the website : Online portal link and select “Apply Online” option under ONLINE APPLICATION option from the home page.
  2. In the new page, please enter your mobile number and hit “Proceed” to reach the next page for detailed instruction.
  3. From the menu please select NEW REQUEST and choose “Surviving Family Member / No Govt Job Certificate” option
  4. In the new page please select Language and “Surviving Family Member Certificate” to reach next page
  5. The resulting page will prompt to enter /select appropriate details. After filling the details, please click “Upload Required Scan Documents” to upload required documents for processing.
  6. Then hit “Online Payment” option at the bottom to get the payment gateway page. Please select appropriate option(Credit / Debit / Net banking) to complete the payment.
  7. You will get an acknowledgement for the transaction and the same would have reached your registered mobile.
  8. Please keep the details safely to get the status of your application.
  9. From this point onwards the process will be same as how they processed in apply in person option to issue the certificate
  10. The application will be verified by the Village Administrative Officer (VAO) and Revenue Inspector (RI).
  11. There will be a ground level verification and scrutiny of the documents and details provided.
  12. Once the verification is over, these officials will submit their report to the Thaasildhaar.
  13. Thaasildhaar will decide to issue the Legal heir Certificate to the applicant with the names of all legal heirs of the deceased.
  14. Applicant will get the certificate in 15 days after due verification

Apply In-Person

  1. In order to apply for Legal heir certificate in Karnataka, applicant has to go to the respective Taluk, Nadakacheri office in whose jurisdiction the candidate usually resides. Link for the office details link
  2. Submit a written application form along with required documents to the authority.
  3. Authorities after checking the attached documents and details submitted, will make entries and provide you record number for reference. The same will be sent to your registered mobile number for future reference.
  4. The application will be verified by the Village Administrative Officer (VAO) and Revenue Inspector (RI).
  5. There will be a ground level verification and scrutiny of the documents and details provided.
  6. Once the verification is over, these officials will submit their report to the Thaasildhaar.
  7. Thaasildhaar will decide to issue the Legal heir Certificate to the applicant with the names of all legal heirs of the deceased.
  8. Applicant will get the certificate in 15 days after due verification

Note:

  • Except the kin of deceased government servants. Everyone else has to obtain a succession certificate through their jurisdictional civil court. Please contact a advocate to apply for this certificate. He will be experienced in applying for this certificate.

In case of Spouse applies for certificate

  • If the spouse survives, Aadhaar, Marriage Registration Certificate or Passport or Voter ID should be submitted
  • Birth certificate or Transfer Certificate of all Children
  • Self declaration of the spouse indicating all other legal heirs (including Mother-in-law if wife is the applicant)

In case of Child applies if parent are deceased

  • Death Certificate of the parents
  • Birth certificate / Aadhaar / Passport / T.C of the applicant and aadhaar card of all possible heirs

In case of Child (minor) applies if parents are deceased

  • Death Certificate of the parents
  • Birth certificate / Aadhaar / Passport / T.C of the applicant and Aadhaar card of all possible heirs
  • Guardianship order issued by the Hon’ble civil court to prove relationship to the heirs

In case of Parents or sibling apply (unmarried children deceased)

  • Death Certificate of the Deceased
  • Birth certificate / Aadhaar / Passport / T.C of the deceased
  • Self declaration of the parents / siblings

InstructionsEdit

  • A legal heir certificate is issued by the government for those individuals whose parent/husband is dead without leaving a will.
  • To establish relationship for claims relating to Insurance, pension, retirement benefits or service benefits of central and state government departments, Government undertakings etc.
  • In legal succession cases to get succession certificate to establish the relationship
  • To get employments for example compassionate appointments.
  • Approach the District Thasildar office with the death certificate and produce the form.
  • All required documents to be submit while lodging the application.
  • It will take around a month to process all the necessary information and receive the certificate.

Need for the DocumentEdit

  • If the head or a member of the family expires, the next direct legal heir of the deceased such as the wife or husband or son or daughter or mother may apply for legal-heirship certificate \ Succession Certificate on application for the purpose of transferring Electricity connection, House Tax, Telephone connection / patta transfer, Bank Account, etc.
  • If the person who died is a Government servant, legal heir certificate is issued for sanction of family pension, and for getting appointment on compassionate grounds.
  • Legal Heirs certificate is an important document in determining the rightful ownership for an asset / property in situation of sudden demise of the Owner as per document registered.
  • Legal Heirs certificate plays a vital role for the prospective buyer, Loan sanction authority and all stake holders to know whom are all the right owners to deal with the proposed property
  • When there is more than one Legal Heir, all the legal heirs must execute Deed of Conveyance.
