Apply In-Person

  1. You should first conduct a search to make sure that there is no patent registered that is similar to yours. You can conduct the search by going to the Jamaica Intellectual Property Office (JIPO), 4th Floor, PCJ Building, 36 Trafalgar Road, Kingston 10 to make the search since all Patents stored at the Jamaica Intellectual Property Office are available for searching by the public for any purpose.
  2. Once you have ascertained that there is no other patent identical to yours, publishes a Notice of Application in the Gazette and a daily newspaper once a week for four consecutive weeks.
  3. Then make a petition as describe in form A in the Patents Act addressed to the to the Governor General of Jamaica along all the required documents including the Declaration and Specification of the patent in duplicate. You can obtain the petition, Declaration and Specification form the Jamaica Intellectual Property Office website:Link or via the links provided in the “Documents to Use” section below
  4. File the complete application to the Intellectual property office and pay the required application fee and you will be issued an acknowledgement receipt for the application file.
  5. Then the intellectual property office will forward the patent to the to the Government Chemist, or the Executive-Director of the Bureau of Standards for technical examination. The examiners will assess whether the invention is new and useful that is, whether it will provide public utility. If these conditions are met, the application is recommended for grant of Patent.
  6. Then the patent will be processed and registered according to the patents act and issued Form of Letters Paten

Required DocumentsEdit

  • Petition: This is the formal request to the Governor General for grant of Letters paten
  • Declaration: This is a sworn statement made by the inventor or his assignee in the presence of a Justice of the Peace that to the best of his knowledge, he is the true and first inventor and that the invention is not in use by any other person or persons.
  • Specification (in duplicate): This is the written description of the invention.
  • If the application is not being filed by the inventor, the following documents may also be required Power of Attorney, Assignment and Affidavit.

A patent is eligible for registration if the following conditions are met:

  • Novelty (not known or used in the island before)
  • Public utility

  • A Patent is valid for 14 years from the date it was granted.

  • It is high recommended that you use the assistance of a qualified lawyer to assist you in the registration of the patent
