In principle, anyone presenting title and a registration note in two originals can, upon payment of the fee, sign off on the note (article 17 of Law No. 52/1985) and request the publication of the property transaction, naturally during office hours (article 2677 of the Civil Code). The person taking receipt will collect the documents and record them in the General Registry for their subsequent allocation to the various particular registries (article 2679 of the Civil Code) and issue a receipt with the admission number (article 2678, 3rd paragraph, of the Civil Code).

The search can be carried out only on those property deeds that have been computerized, and on those properties for which the tax code used in the search corresponds to that of the registered holder in the cadastral archives.

If there are any inconsistencies or errors in the information contained in the archives, it is possible to contact the Contact Center and the Provincial Offices of the Territorial Agency.

To access the service you must register on the web site of the Inland Revenue. Once registered, you may start searching by using the PIN code provided by the Inland Revenue.

The Inland Revenue Office - together with the Territorial Agency - is committed to providing citizens with data and information; by using "Search for cadastral data by tax code", it is now possible to obtain the cadastral data of properties online.

By indicating the tax code of a property owner, the province and the cadastral area where the search is to be carried out, it is possible to obtain information relating to property situated throughout Italy (excluding the autonomous provinces of Trento and Bolzano).

Need for the DocumentEdit

The Pledge and Liens certificate (Visura Ipotecaria) is a certificate stating whether a person, natural or legal person, is the owner of real property and the presence of pledges, encumbrances or other liens on them.

Visura ipotecaria is the search carried out on the mortgage register to check that the property is unencumbered by a mortgage.

It shows whether the property is burdened with charges such as mortgages, loans, court orders or adverse entries.

If one conducts a search (known as a visura ipotecaria) to discover whether a person is the titleholder to a particular property, if the result is positive the registration note will be returned and from this you may trace the basis for the title and examine it, should you wish to know the terms of the agreement under which the asset was acquired



Other uses of the Document/CertificateEdit

  • The mortgage certificate is a document issued by the registrar of the land registry that contains the certified copy of the transcripts / entries / records or confirmation that there is not any.
  • The certificate includes general mortgage copies of all notes that are the inspection paper and / or electronically in which this is the subject for which it is required; special mortgage certificate, however, contains copies of the notes relating to a subject limited to one or more specified properties.
  • The certificate, general or special, is required by the Department of Real Estate Services in advertising Provincial Offices - Land, for example, procedures for the allocation of social housing or foreclosure and expropriation.
