Apply In-Person:
- To Enforce a Divorce Decree, the applicant has to approach the United States Court link
- Note: Search by address, city, state, or ZIP Code and click the “Location” button.
- The applicant has to write a request letter to the court clerk officer.
- An application form will be provided to the applicant by the concerned officer. (if required)
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the court office.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- The applicant has to pay the prescribed fee as requested by the authority.
- Before taking any action, review the divorce decree to ensure that the applicant understands the terms that need to be enforced.
- The court that handled the divorce may have jurisdiction over enforcing the decree. If not, the applicant may need to file a motion for enforcement in the court that has jurisdiction over the matter.
- If the applicant's ex-spouse is not complying with the terms of the divorce decree, the applicant may need to file a motion for enforcement with the appropriate court.
- The motion should detail the specific terms that are not being upheld and request that the court take action to enforce those terms.
- The applicant will need to serve a copy of the motion for enforcement on your ex-spouse following the rules of civil procedure in the state.
- The court will set a hearing on the motion for enforcement. The applicant and his/her ex-spouse will have an opportunity to present evidence and argue their respective positions.
- If the court finds that the applicant's ex-spouse violates the divorce decree, it may issue a court order compelling them to comply with the terms of the decree.
- The court may also award the attorney's fees and costs associated with bringing the motion for enforcement.
- If the applicant's ex-spouse still fails to comply with the court order, the applicant may need to take additional legal action to enforce the order, such as garnishing their wages or placing a lien on their property.
- This entire process can be completed within 4 - 5 weeks or as per the timeline advised by the respective department authority.
