ProcedureEdit

  1. Get an affidavit declaring your single status. (Other info like your Passport number, address, date of birth etc needs to be clearly mentioned)
  2. Get a stamp from Sub district magistrate or District magistrate or Court. (None of these parties willingly provide the stamp)
  3. Take it to Home department and get it attested.
  4. Then take this affidavit to the Ministry of External Affairs or branch office and get the apostle.
  5. You need to take a demand draft of postal order for 50 INR.
  6. Take this to the Indian embassy or to other foreign embassy where you wish to marry.
  • Since getting apostille (Ref 3,4 & 5) on the certificate is a time consuming and tedious task, you could get some agents to get it done for you.
  • The apostille should be done in ten days.

EligibilityEdit

In order for non-nationals to marry in a foreign country you will most likely be required to produce legal documentation from your country of citizenship verifying single status and that you are free to marry. This is known as a 'Certificate of No Impediment', 'Certificate de Coutume', 'Certificate of Nulla Osta' or a 'Certificate of Freedom to Marry'.

  • A single status affidavit is a sworn statement that you are eligible to marry which is also known as the Certificate of No Record or a Certificate of No Impediment or a Certificate of Nulla Osta or a Single Status Statutory Declaration or a Certificate of Legal Capacity to Contract Marriage.
  • You need to get the notary attestation on the stamp paper declaring you are single.
  • Also you need to get the attestation from Sub Divisional Magistrate also get Apostille from Ministry of External Affairs and Embassy of the concerned Country.

(In Pune you are able to get the single status affidavit stamped with the executive magisterate at the nagrik suvidha kendra which is near the Univeristy of Pune main entrance, shivaji nagar. Make the affidavit on a 100Rs stamp paper and sign do not take notary stamp and visit the office between 10AM to 1.30PM (those are the affidavit timings). they will as usual do some fuss about not knowing the procedure but they have the authority to stamp this affidavit. They will charge Rs 34 as of April 2019. then the steps 3 onward can be followed)
