Procedure

Apply In-Person:

1. To obtain license for electricity Distribution services from Energy Commission in Ghana, the applicant has to approach the Ghana Electricity Commission office contact link
2. Applicants can obtain the application form from the Ghana Electricity Authority office.
3. An applicant should submit a signed application letter addressed to the Executive Secretary of the Commission.
4. Documents that are needed for this procedure are mentioned under “Required Documents” section of this page.
5. Applicants should attach receipt confirming the payment of the prescribed licence application fee and that can be found under the "Fees" section of this page.
6. The submitted details will be verified by respective receiving authority. If all the details and documents are in place, application will be accepted.
7. Applicant will get a receipt as acknowledgement for the submission of application.
8. This application will be processed by the respective department.
9. Applicant gets notification about the issuance.
10. After getting the notification from concerned authorities, applicant can visit the office to collect their license.
11. The application will be processed within six months.

Required Documents

Copies of the following documents shall be enclosed

• 1 hard copy of the following exhibits as separate attachments, clearly labeled and all pages sequentially numbered and initialed.
• Memorandum of Association and Articles of Association
• Original power of attorney in favor of the signatory to commit the applicant
• Application form with a signed declaration/disclosure statement by each Director/Principal Shareholder of the company relating to any liabilities or investigations affecting their suitability as a Director/Shareholder of a licensed company.
• Certificate of Registration
• Certificate to Commence Business
• Copies of the applicant's financial arrangements to conduct electricity business as a business activity (e.g., guarantees, bank commitments, contractual arrangements, credit agreements, etc.).
• Two years of forecasted financial statements (balance sheet, income statement, and cash flow statement)
• Fire Certificate
• Evidence that the applicant has the capacity to comply with the license conditions, codes and guidelines relevant to its application
• Passport size picture (write your name and phone number behind picture)
• Original copy of pay-in slip to the form
• Proof of identity (citizen card/ driving license/ passport /if any)

Notes:

• Energy Commission reserves the right to review license fees by Public Notice.
• EPC is the Engineering and Procurement Contract
• Initial Licence Fee: This is a one-time payment fee for a new license for construction of a facility
• Annual License Fee: This is an annual payment for the maintenance of valid existing licenses
• Amendment Fee of 50% of the Application fee shall be charged.

Validity

• License for electricity Distribution services license validity is 20 years.

• The Energy Commission was established by an Act of Parliament, Energy Commission Act, 1997 (Act 541), among other things, to license and regulate the technical operations of service providers in the electricity supply industry. The Commission performs these regulatory functions through elaborations and enforcement of licensing conditions, technical rules of practice and standards of performance rules.

Need for the Document

• To be able to Transmit, Distribute or Generate power for sale, applicant need to apply for a license from Electricity Commission office in performing its function, the commission’s primary focus is balancing the interest of market participants and the protection of Ghanaian consumer interest with respect to price, quality and consistency of power supply.

• Details of ownership as in Form C (Schedule I), and diagram of corporate structure (where applicable) including;
  • A list and description of all existing, pending or past rulings, judgments, contingent liabilities, revocation of authority, regulatory investigations, or any other matter that could adversely impact the applicant’s financial or operational status or ability to provide the services it is seeking to be certified to provide
  • A statement whether the applicant or any of his associates, or partners, or promoters, or Directors was ever refused license or had license cancelled, and if so, the particulars of such application, date of making the application, date of order refusing or cancelling license and reasons for such refusal or cancellation.
  • Each partner, director or major shareholder (with any share ownership) is required to provide a declaration/disclosure statement (Ref: Exhibit B1) relating to any existing, pending or past rulings, judgments, contingent liabilities, revocation of authority, regulatory investigations, or any other matter that could adversely impact the applicant’s financial or operational status or ability to provide the services it is seeking to be certified to provide.
• Information on cross-ownership and ring-fencing. This should outline the following:
  • Details of cross-ownership in other businesses by shareholding.
  • The basis on which services and resources will be transacted between relevant operating areas of the applicants, or the applicant and its other related entities.
  • In the case of applicants that are wholly owned subsidiaries, information on proposed audit arrangements should be provided and also stated whether separate reports for the licensee and its parent company (if applicable) are to be prepared and made publicly available.
• “Local Content and Local Participation” A plan detailing (a) the role and responsibilities of the indigenous Ghanaian; (b) the equity participation of the indigenous Ghanaian; and all other shareholders and (c) the strategy for the transfer of technology and know-how to the indigenous Ghanaian company.
