ProcedureEdit

  1. Complete an application form. A link is provided under "Documents to Use" section which you can use to download the form.
  2. Your trade mark application must contain the following:
    1. Concrete data of the applicant,
    2. a representation of the trade mark,
    3. a list of the goods and services.
  3. You can send your application in advance by fax (089/2195-4000) to the DPMA. Make sure that you send each application or other communication separately. This will make it easier for the Patent and Trademark office to match your fax documents in the trade mark department.
  4. The German Patent and Trade Mark Office will review your application for so-called absolute grounds for refusal. Signs or indications are excluded from registration if they merely describe the kind, quality or other characteristics of the goods or services claimed. The Office does not check whether similar or identical trade marks have already been registered.
  5. If the application complies with the legal requirements and if there is no obstacle to registration, the German Patent and Trade Mark Office will enter the trade mark in the register. The registration is published in the electronic Markenblatt (trade mark journal).
  6. The owner of the trademark will receive a certificate of registration.

Note: A trade mark might be cancelled at the outcome of an opposition procedure due to earlier trade mark rights.

The applicant may be:

  • a natural person (private individual),
  • a legal person or
  • a partnerships having legal capacity

ValidityEdit

A trade mark registration can be renewed indefinitely and last forever. If the renewal fee is not paid every ten years, the registration will be cancelled.

Other uses of the Document/CertificateEdit

Registration of a trade mark grants its owner the exclusive right to use the trade mark in relation to the protected goods and/or services. Trade mark owners can sell and assign their trade marks anytime. The owner of a trade mark can grant others a right of use of the trade mark (trade mark licence).
