Georgia - Apply for Residence Permit

ProcedureEdit

To obtain Residence Permit in Georgia or prolong its validity term, a foreigner staying in Georgia applies to any territorial office of Public Service Hall or Public Service Development Agency.
A foreigner staying in other country may present an application for prolongation of validity term of Residence Card of Georgia in the electronic form through filling in an application uploaded at the website of the agency.

Attention, please! A foreigner must apply for Residence Permit to the agency 40 calendar days prior to expiration of the term for his/her legal stay on the territory of Georgia.

An application regarding Residence Permit of a minor shall be presented by one of his/her legal representatives or authorized person of a legal representative. If a type of Residence Permit that is to be issued to a minor envisages issuance of Residence Permit with the right of temporary residence, an application of one of legal representatives of a minor is enough.
If a type of Residence Permit that is to be issued to a minor envisages issuance of Residence Permit with the right of permanent residence, consent of non-applying legal representative should be attached to an application of one of legal representatives of a minor. If an authorized person of a legal representative of a minor submits an application requesting any type of residence permit, consent of both of legal representatives is required.

EligibilityEdit

Following persons may present an application for Residence Permit or prolongation of its validity term :

A capable foreigner of full legal age, in person.
A legal representative of a minor foreigner (under 18 years of age), except for a foreigner from 16 to 18 years of age having registered marriage.
A guardian of a ward.
A representative of an interested person (if an interested person is in Georgia), based upon the properly attested Power of Attorney.

FeesEdit

For Permanent Resident Permit :

On the 30th calendar day 180 GEL

Within 20 calendar days 300 GEL

For Temporary Resident Permit :

On the 30th calendar day 210 GEL.

On the 20th calendar day 330 GEL.

Within 10 calendar days 410 GEL.

ValidityEdit

Temporary Residence Permit is issued for at least 6 months for the first time and its validity term shall not exceed 1 year. Its validity term might be prolonged for other 5 years, provided that the total validity term of Temporary Residence Permit should not exceed 6 years;
Temporary Residence Permit of a former Georgian citizen might be issued for 6 years;
A short-term residence permit shall be issued for 1 year;
A person holder of a status of stateless person, established in Georgia, shall be issued Residence Permit for 3 years or with the right of permanent residence;

Following listed are the different kind of Resident Permit with the right of temporary residence are issued in Georgia:

Labour Residence Permit : is issued in accordance with the rule prescribed by law to exercise the entrepreneurial or labour activities in Georgia, as well as to a person holder of free profession.
Educational Residence Permit : is issued for the purpose of study at any educational facility authorized in Georgia.
Residence Permit for Family Reunification : is issued to family members of a foreigner holder of Residence Permit.
Residence Permit of a Former Citizen of Georgia : is issued to a foreigner whose Georgian citizenship has been terminated.
Residence Permit of a Stateless Person : is issued to a person who holds a status of a stateless person established in Georgia.
A Temporary Residence Permit : is issued to a foreigner who has been awarded a status of a victim subject to the Georgia law on suppression of a family violence, on protection of and assistance to victims of family violence.
Special Residence Permit is also issued :

To a foreigner, when there is a reasonable assumption that s/he may be a victim (suffered) of the trade of humans (trafficking).
To a foreigner, when the written initiative regarding issuance of a temporary residence permit is presented by a member of the Georgian government.
To a foreigner who could not be deported and accordingly Temporary Identification Card has been issued and 5 years elapsed from issuance of Temporary Identification Card.
To a foreigner holder of a status of compatriot.

Note: While issuing Residence Permit for Family Reunification, the following persons are deemed as family members: a spouse, child, parent of a foreigner residing in Georgia, as well as a minor, incapable or disabled person being his/her dependent or under custody.

Following types of Residence Permit with the right of permanent residence in Georgia are issued:
Permanent Residence Permit : is issued to a spouse, child, parent of Georgian citizen. Permanent Residence Permit shall be issued to a foreigner, residing in Georgia based upon a temporary residence permit for the past 6 years. This term does not include the period of residing in Georgia for the purpose of study or medical treatment and of working at the diplomatic or equal representations. Note: While issuing of Permanent Residence Permit, a spouse, parent and child of Georgian citizen are considered as family members.
Investment Residence Permit : shall be issued to a foreigner who made the investment amounted to at least 300 000 GEL in Georgia in accordance with the Georgian law on support and guarantees for investment activities and to his/her family members. For the purposes of this sub-paragraph, a spouse, minor child and incapable or disabled person being his/her full dependent are deemed as family members. Note: While issuing of Investment Residence Permit, a spouse, parent and minor child of a foreigner holder of Investment Residence Permit and incapable or disabled person being his/her full dependent are deemed as family members.
Residence Permit of a Stateless Person : shall be issued to a person who holds a status of a stateless person established in Georgia. Note: Residence Permit with the right of permanent residence is issued to a stateless person, if his/her Georgian citizenship has been terminated in the manner of withdrawal from citizenship of Georgia or s/he has permanently resided in Georgia as of March 31, 1993 , has not been deregistered but has not been considered as a citizen of Georgia.
