Florida - Obtain Marriage License

- Go to the courthouse in the location where you plan to get marry.
- Present proof of identity and other required documents.
- Pay the marriage license fee.
- Read through the marriage law handbook the clerk gives you.
- Obtain your Florida marriage license and adhere to the time restrictions.

- proof of identity: a picture ID such as a drivers license, state ID card, or valid passport
Note: Both parties will also have to provide their Social Security numbers, but do not need to provide their Social Security Cards.

EligibilityEdit
The legal age is eighteen (18). If either party is under the age of eighteen (18) but at least the age of sixteen (16), the clerk cannot issue a license unless a notarized written consent of parent(s) or guardian(s) along with driver's license, identification card, or passport of all parties is presented and filed.
However, the license shall be issued without parental consent when both parents are deceased or when a minor has been previously married.

- Marriage License Fee:$93.50
Note: It can be reduced by up to $32.50 if you complete a licensed Florida pre-marital course.
ValidityEdit
All Marriage Licenses are valid for sixty (60) days. If you are not married within the sixty (60) days, you will have to obtain a new license.
A standard marriage license requires a 3-day waiting period before a marriage ceremony can be performed.
Exceptions to the 3-day waiting period are:
- If both applicants reside out-of-state and are able to present valid proof of photo identification indicating their out-of-state address at the time of filing the marriage license application. (You may call the County Courthouse's office for other acceptable proof.)
- If the applicants present an original pre-marital course completion certificate at the time of filing the marriage license application.

The Clerk of the Circuit Court acts as an agent for the State of Florida for issuing licenses per Florida Statute 741.
- You and your partner must both be present in the office when you apply for a marriage license.
- You will need your valid drivers license or picture identification card and social security number.

The following officials are authorized by Florida law to perform marriage ceremonies:
- Ordained clergy
- Elders in communion with a church
- All Florida judges
- Clerks of Court and their deputized employees
- Notaries Public of the State of Florida
The law provides that ceremonies also may be performed among Quakers or "Friends" in the manner and form used or practiced in their societies.
A marriage cannot be officially recorded until the license is returned to the Clerk. It should be returned within 10 days of the wedding. The party that performed the marriage is responsible for returning the completed license.
