ProcedureEdit

1.The applicant starts by identifying and obtaining property / land. The land / property is obtained by purchasing it from the original owner by course of agreement on the value of the property, in this case, the applicant is referred to as the buyer where as the original owner is referred to as the seller;

2.When buyer and seller agree on the value of the property, they contact a legal person (a lawyer, notary or attorney) to assist and take them through the entire process. The buyer and seller go to the legal person with the title of property in question for a sale purchase agreement to be drafted.;

3.There after the contacted legal person goes ahead to check for availability of property. In this case, the notary / attorney checks for any mortgages, covenants, caveats and easements on the property at the Service des Domaines (Conservation de la proprit foncire);

4.Thereafter, the notary / lawyer /attorney proceeds to tax authority (bureau de lEnregistrement et du timbre) to check status of the property and capital gains

5.Then when the property is found available, the seller and buyer are called upon by the notary / attorney to sign the earlier drafted agreement. In this case, both parties (the buyer and seller) sign the agreement.

6.After the agreement has been signed, the notary / attorney / lawyer proceeds with registering agreement with the tax authority (bureau de lEnregistrement et du timbre);

7.Thereafter, the notary / lawyer / attorney proceeds with submitting request for change of name on the original land title on behalf of the new owner. This is done by submitting all required documents to the Conservation de la proprit foncire;

8.When submitted documents are received, they are reviewed and assessed and if approved, the name of the new owner (buyer) is inserted on the original land title and is issued to him / her

1.Always use a legal person in the process of obtaining an original title;

2.Ensure that the seller is the true owner of land;

3.Before signing an agreement ensure that the land is available with no mortgages or caveats;

4.A sales / purchase agreement must be drafted;

5.The seller and buyer must sign the drafted sales / purchase agreement;

6.Inserting signatures on the sales / purchase agreement must be in presence of a legal person (Notary / attorney / lawyer)

7.Payment of registration fees at the tax authority is made directly at the lhtel des impts;

8.Procedures take place simultaneously with one another;

An original land title is an official record of who owns a piece of land. In Djibouti, an original land title is obtained by registering property / land with the Land Registry.
