Apply In-Person:

  1. To Apply for LPC (Legal Proceedings Certificate), the applicant has to approach the Registrar of Trademark Offices link
    Note: The applicant has to approach any one of the nearby offices.
  2. Applicant has to write a letter to the Registrar of Trademarks requesting the issuance of the LPC, specifying the details of the legal proceedings and the reasons for requesting the LPC.
  3. The letter should also include the applicant’s contact details and the details of the trademark for which the LPC is being requested.
  4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  6. Submit all the documents with the completed form to the concerned officer.
  7. The fee details are mentioned in the “Fees” section of this page.
  8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
  9. All applications are processed within a reasonable time, having regard to the particular circumstances of each application, including the completeness of information and documents submitted to the authority by the applicant.
  10. The authority may seek additional information from an applicant if this is necessary to assess the application. The authority does not need to deal further with an application until the applicant has provided this additional information.
  11. Once everything is accepted the authority will issue the legal proceeding certificate.
  12. This entire process can be completed within 30 days or as per the timeline advised by the respective department authority.

EligibilityEdit

  • In a trademark case in India, both the plaintiff (person initiating the legal proceedings) and the defendant (person against whom the legal proceedings have been initiated) are eligible to obtain a Legal Proceedings Certificate (LPC) from the Registrar of Trademarks



FeesEdit

  • LPC for initiating opposition proceedings against a trademark: INR 3,000
  • LPC for initiating legal proceedings for trademark infringement: INR 5,000
  • LPC for renewal of validity for a further period of six months: INR 2,000
