ProcedureEdit

1.In order to obtain an Original Land Title, in Cte dIvoire, the applicant must first register land and in order to register land successful, a legal person (Notary / Attorney / Lawyer) should be contacted to help in the process. Therefore an applicant should start by finding a registered legal person who will be assisting in the process;

2.When a legal person is contacted, he / she starts with going to the Land Registry (Conservation de la Proprit Foncire et des Hypothques) and request for the real estate rights record. This is to search for availability of land;

3.Thereafter, the legal person goes to the tax authority (Direction Gnrale des Impts de Cte d'Ivoire) to obtain a tax clearance certificate. The certificate obtained should indicate that all taxes related to the land are cleared;

4.When a tax certificate is obtained, the applicant through the contracted legal person proceeds with obtaining a location certificate (certificat de localization). In this case, the legal person submits a request to a certified land surveyor. Upon request, they surveyor surveys the land and thereafter generates certificate which indicates details of a given land;

5.If the applicant who wishes to obtain an original land title obtained land by purchase, a sales agreement is prepared by the legal person and if land was transferred to the applicant, a transfer agreement is prepared and then the drafted agreement is signed by both parties (the original owner and new owner / applicant);

6.Thereafter the legal person submits a request for registration of land agreement prepared above for registration at local tax authorities. At this stage, he / she submits the agreement and a registration fees is paid;

7.Then the legal person after registration at the local tax authority will proceed with transferring land from the original owner to the new owner / applicant. In this case, he / she submit application for transfer of land to the Land Registry;

8.The submitted documents are assessed and thereafter, transfer is made and a New Land certificate (New Land Title) is issued to the applicant.

InstructionsEdit

1.Applicants are advised to use a legal person in the process of obtaining title;

2.In cases where a tax clearance cannot be obtained, the notary can execute the contract on behalf of a party;

3.In cases where a notary executes contract on behalf of a party, a tax certificate must be obtained within one (1) month;

4.In most cases at registration at the local tax authority, a vendor is required to pay 3% for Capital Gains Tax

5.Applicants must ensure that a Location Certificate (certificat de localization) has information included on the present title, land survey data, and a description of the state of the parcel;

6.Ensure that all taxes that are attached to the land are cleared before applying for a land title;

7.Land to be registered must have be obtained from the true owner;

8.Applicants must be able to prove that land was obtained in the right way for instance by presenting sales agreements or transfer agreement or any other documents that can provide proof;

9.In order to reduce time, some of the processes can be done simultaneously
