Cambodia - Apply for a Deed Poll

ProcedureEdit

1.An applicant should start by decide the type of deed poll he / she would like to apply for. It could either be an adult poll deed or a child poll deed;

2.Thereafter declare to give the old expression and adopt the new actions committed in the deed poll;

3.After making a declaration, the applicant and witness sign the deed;

4.There after pay for a stamp / seal so as to be inserted on the deed poll.

The stamping / sealing must be done by a notary or attorney;

5.When deed has been stamped / sealed, the applicant may choose to enroll or not to enroll it. Enrollment involves placing the commitment / new expression on a publicity accessible record and this is usually done in the central office of high court.

2.A deed pool must have a date;

3.Declarations and signing of poll deed must be in presence of a witness;

4.A witness can either be a friend, neighbour or colleague at work who must have made an affidavit before a commissioner or solicitor;

5.The witness should also insert signature on the deed poll;

6.Applicants for deed polls on behalf of a child must have parental responsibility for the child;

A deed poll is a legal document binding only to a single person or several persons acting jointly to express an active intention. With a deed poll, you can change your forenames and/or surname, add names, remove names or rearrange your existing names. You can change your name at any time and for any reason provided it is not to deceive or defraud or to avoid an obligation. The law governing the use of deed polls In Cambodia is the Registration of Documents Act, and the change of names regulations set out in the act. For one to be able to change their names using a deed poll, they must be at least 18 years of age.

A 18-year-old is however is old enough , and therefore, all that is required of them is consent, in the presence of an advocate, but the entire process is commenced by you in person. For a minor below 16 years of age, no consent is required from them, as they are still of tender age.
