InstructionsEdit

  • It is not a requirement to be a California resident for you to marry.
  • Both parties must apply in person and bring valid picture identification when applying for a marriage license.
  • All fees and hours of issuance for a marriage license may vary by county.
  • The copy of your marriage license will be obtained after you have been married unless you request for a certified copy from the County Clerk and pay for it.
  • There are two types of marriage license:
    • Public Marriage License
      • It may be obtained from any county in California.
      • It is not a requirement to get married in the county where you purchased the license but you must be married in California. The license must be filed where it was purchased.
      • At least one witness must be present at your ceremony. The witness must be old enough to know what they are witnessing and sign their name on the official marriage license.
      • The marriage license is registered at the County Recorders Office in the county where the license was purchased, and is a public record. Anyone may request copies of the marriage certificate by submitting the required fee to the County Recorder.       • Only one officiant may sign the marriage license as the person who solemnized the marriage.
    • Confidential Marriage License
      • The couple must be living together as spouses at the time they apply for the marriage license, and must sign an affidavit on the license attesting to that fact.
      • The couple must be married where the license was issued.
      • Witnesses are not required at the ceremony and no witnesses sign on the marriage license.
      • The marriage license is a confidential record and is registered at the County Clerks Office in the county where it was purchased. Only the couple may purchase copies of the marriage certificate. Persons other than the parties to the marriage requesting copies of a confidential marriage certificate may only do so by presenting a court order to the County Clerk in the county where the license is registered.

Following are the procedures on how to obtain a marriage license in California. The County Clerk issues public and confidential marriage licenses. The County Clerk is the local registrar of confidential marriages (Family Code, Section 511). The County Clerk maintains a permanent index of all confidential marriages registered.
