Procedure

Apply In Person

1. The application for a Radio Licence shall be made to the Botswana Communications Regulatory Authority (BOCRA), whose mandate is to license and regulate all communications systems and services in the country. BOCRA Contact Details

The application should be filed through a licensed radio dealer and the application process commences by collect and completes the following forms, Frequency Application Form and License Renewal Application Form obtain at the BOCRA offices or download it via the BOCRA website, BOCRA Application Forms or directly download it using this link, Frequency Application Form
3. Please Note: Under the heading applications, clearly indicating the type of service he/she is running and areas of operations.
4. The applicants are required to enclose, five (5) copies of their application; i.e. certified copies of the relevant supporting documents and accompanied by a comprehensive business plan as explained below under the “Required Documents” section of this page, in addition to the duly completed application forms in all respect, in a manila envelope addressed to the Executive Chief, Botswana Telecommunications Authority, and should be submitted to the BOCRA head office either in person or via post. Any omission of these documents will render the application process incomplete.
5. Upon submission, the application is checked for completeness and correctness by the receiving officer, if everything is in order the applicant will be required to pay a prescribed application fee of BWP 5, 000.00 (Non-refundable). Which is payable either cash at the BOCRA office, by depositing it into the BOCRA account, or can be received through the Point of Sale (POS) machine (swiping machine) at the BOCRA offices. Alternatively, you can pay by cheque written in favour of the BOCRA.
6. The application will only be registered to be processed when payment of the application fee has been made, the applicant will be issued with an acknowledgment slip that proves submission of the application file and for inquiry referencing if the need arises.
7. The Authority shall respond within seven (07) working days after receipt of the application for acknowledgment of receipt, including the next step of action.
8. The application will be processed as per the information and documentation provided, that is why applicants are advised to provide sufficient information to enable the BORCA licensing board to evaluate the business/company and make its decision.
9. The BOCRA licensing board evaluates and processes the radio licenses application on a first-come-first-served basis and the turn-around time is ninety (90) working days.
10. If the application is accepted, the BOCRA licensing board may request additional information relevant to the application for the purpose of ascertaining compliance by the applicant with all applicable laws and regulations. In such a case, the information must be submitted within the stipulated time from the date of notification. Where the applicant fails to submit the required information, the BOCRA licensing board shall reject the application.
11. After processing, a notice of the decision (Approval, Deferral, or Rejection) for the application will be communicated to the client in writing.
12. Upon satisfying the Authority with the preliminary requirements, a draft license is sent to the Applicant to consider. Negotiations of Terms and Conditions of the Licence will then follow (negotiations can take as long as the Authority deems essential).
13. Upon coming into an agreement, the BOCRA will notify the Minister of the approved license.
14. The licensing board will direct the registrar to register the applicant with the BOCRA and draw up the Radio license and made available for withdrawal by the applicant at the BOCRA dispatch office, against the applicant identification document, acknowledgment receipt, and approval letter and upon payment of prescribed annual license fee as listed on the BORCA Fees structure.

Required Documents

• A copy of the valid company registration certificate

• Proof of payment (application fee).
• List of equipment which they plan to purchase or have in their possession as well as the geographical coordinates and the altitude of the transmitter sites and the height above ground of all antennas.
• Comprehensive Business Plan covering at a minimum the following:
• Company information on shareholders, directors, place of domicile, certificate of incorporation.
• Type of network to be built and roll-out plan.
• Network diagrams and explanations · indications of resources required from the BOCRA which may include amongst others telephone number blocks, spectrum
• Minimum of 5 years financial projections cash flow and income statement
• Target customers.
• Products and services and associated prices
• Value Proposition
• Details of Management Team (CVs) showing technical and business management capability.
• Financial capability is supported by proof of funding from a financial institution.
• A performance bond may be required.
• Indication of resources that may be required from BOCRA

NOTE:
All copies of documents submitted to the Authority are to be certified by a Commissioner of Oaths.

Eligibility

Applicants should meet the following requirement to be eligible to apply,

• The entity should be registered in Botswana as a company, sole proprietor, or partnership.
• Have a duly registered office and permanent premises in Botswana.

Fees

• The commercial broadcasting services application fee is BWP 5, 000.00. These fees must accompany the application and are not refundable.

Validity

• The Radio License is valid for ten (10) years from the date of issue and shall remain valid for that period specified unless suspended, cancelled, or revoked by the authority.
• Upon expiring the license is subjected to renewal.

Processing Time

• Successful applicants will be awarded their license within ninety (90) working days of application submission, provided that the applicants have submitted all the necessary information requested by the Authority for evaluation purposes and that Authority has completed all the clarifications with the applicants.
