Procedure

Apply In Person

1. An application for a Mineral Location Licence shall be made to the Department of Mines, Housed at Ministry of Basic Education building floor 4. Ministry of Basic Education Office Location & Contact Details
2. The application shall be made in writing using a prescribed form, the Mining License Application Form V (a), obtainable at the Department of mine office or directly download it using this Mining License Application Form V (a)
3. The completed application form attached to all supporting documentation as listed under the “Required Documents” should be submitted to the Department of mine office for processing.
4. Upon receipt of the application, it is checked for completeness and correctness by a Department officer before it is registered for processing and consideration by the Department director/authorized official.
5. The Director may, by notice served on an applicant, require the applicant to furnish in writing, within a reasonable time as is specified in the notice, such further information in connection with the application as the Director may reasonably require. Where the applicant fails to submit the required information, the director shall reject the application.
6. During the evaluation process, the director shall consult with other relevant departments such as the Department of Water Affairs and any other relevant Department before deciding on the merits of each application.
7. Any issues resulting from the evaluation stage are brought to the attention of the applicant, who will be given an opportunity to address the issues.
8. After processing, the director shall notify the applicant in writing of his decision with respect to the application (Approval, Deferral, or Rejection).
9. The Director shall approve the grant of the Mineral license if he/she is satisfied that the applicant has met the required eligibility criteria and the waste management facility will not cause pollution of the environment or harm to the human, animal, or plant life.
10. If approved, the applicant will be required to make payment of an annual lease rental fee charged at BWP 100.00 per square kilometre, the first annual lease is paid on receiving the mining license and then paid annually on the anniversary of the license.
11. The applicant will be required to produce the license payment slips/ acknowledgment slip and identity document to be validated by the department-authorized official while collecting the license.

NOTE;

• The permit/license shall be subject to such terms and conditions as the Director deems fit to impose in each case, and such terms and conditions or requirements shall be endorsed on the registration license/permit.
• Any person aggrieved by the refusal of the Director to issue the license may, within 28 days from the date of such refusal, appeal against the refusal to the Minister.

• Parent company guarantee.
• Certificate of incorporation.
• Company documents and identity documents of directors and shareholding.
• Bankable Feasibility Study report.
• Proposed rehabilitation program.
• Letter of surface rights. from the land authority or land owner with a stamped sketch plan showing coordinates.
• Letter of authorization from the Environmental Impact Assessment; from the Department of Environmental Affairs (DEA).
• Letter of authorization from Archaeological Clearance with location coordinates; from the Department of National Museum and Monuments (DNMM).
• If applying within a conservation area, clearance from the Department of Wildlife and National Parks.
• Copy of prospecting license, a retention license, or a prospecting waiver; from the Department of Mines.

Eligibility

To be eligible to apply applicant should meet the following criteria

• The company/ businesses should be owned by Citizens and non-citizens in case of a foreign company.
• The applicant should have a valid prospecting license, retention license, or a prospecting waiver
• Additionally, the Company has:
  • To have established an domicilium citandi et executandi in Botswana.
  • To operate under the incorporate company act and carry business of mining as outlined in the license.
  • The company should not be in liquidation or under judicial management, only where such liquidation or judicial management is part of a scheme for reconstruction or amalgamation of such company.
  • None of the Directors or Shareholders are declared ineligible for an office, activity, or competition because of an offense or infringement.

Fees

• An annual lease rental fee is charged at BWP 100.00 per square kilometre, the first annual lease is paid on receiving the mining license and then paid annually on the anniversary of the license.

Validity

• The validity of the license shall be mentioned on the document and shall remain valid for the time stipulated on the document unless suspended, revoked, or cancelled by the Authority.
