Apply In-Person:

  1. To Apply for Inheritance Certificate, the applicant has to approach the respective district court link
    Note: Click on the respective district to find nearby court offices
  2. An application form will be provided to the applicant by the concerned officer
  3. The applicant has to fill in all the necessary details in the application form.
  4. The applicant has to attach the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application while submitting.
  6. Submit all the documents with the completed application to the concerned officer.
  7. Then the concerned officer will provide the assessment slip to pay the prescribed fee as requested.
  8. The appropriate Court will start the proceedings by giving an opportunity for the preliminary hearing of the application and if the application is admitted.
  9. After the preliminary hearing, the Judge will fix a date for the final hearing and also send notice of the hearing to the appropriate person whomever the judge thinks appropriate.
  10. After the final hearing, when the Judge decides the right thereto to belong to the applicant, the Judge shall make an order for the grant of the certificate to the applicant.
  11. If the Judge cannot decide the right to the certificate without determining questions of law or fact which seem to be too intricate and difficult for determination in a summary proceeding, he may nevertheless grant a certificate to the applicant if he appears to be the person having prima facie the best title thereto.
  12. When the District Judge grants a certificate, he shall therein specify the debts and securities set forth in the application for the certificate, and may thereby empower the person to whom the certificate is granted-
  13. To receive interest or dividends on, or
  14. To negotiate or transfer, or
  15. Both to receive interest or dividends on, and to negotiate or transfer, the securities or any of them.
  16. This entire process can be completed within 4-8 weeks or as per the timeline advised by the respective department authority.

Need for the DocumentEdit

  • An Inheritance Certificate is a document that gives authority to the heirship of a deceased person, to represent the deceased for the purpose of collecting debts and securities due to him or payable in his name. A succession Certificate is granted by a Civil Court to the legal heirs of a deceased person who dies without leaving a will. It establishes the authenticity of the heirs and gives them the authority to have securities and other assets transferred in their names as well as inherit debts.
