Introduction

A Trade/Service mark is a word, symbol, logo or combination of both, which distinguishes the goods of a person or organisation from the goods of others in the market place. A registered trademark gives a proprietor exclusive rights to use the mark for the designated services of the mark.

This procedure provides you information about how to register a trademark.

Instructions

Applications for Trademark registration are submitted at the Intellectual Properties Section of the Registrar General’s Department.

As of the moment, Trademark registration is only offered at the Registrar General’s Department, in Nassau, New Providence, The Bahamas.

When to submit your application: In the case of applicants wishing to claim priority having their trademark registered in another country, the trademark must be filed within a six month period.

Required Information

A list which displays the kind of information which is required to complete the procedure.
e.g.
1. Date of Birth.
2. City or County of Birth.

Procedure

  1. To apply for the procedure you will need to complete these application forms (the forms can be obtained at the Intellectual Properties Section of the Registrar General's Department):
    1. Form No.1 (Form of Authorisation).
    2. Form No.2 (Application Form).
    3. Form No.3 (With additional representations of the Trademark).
  2. Submit the completed forms at the Intellectual Properties Section of the Registrar General’s Department.
  3. Pay the applicable fees.

Fees

The trademark application fees depends on the size of the logo and also on the amount of classes the applicant wishes the trademark to be registered in.

Validity

Explain the time until which the certificate/document is valid.
e.g. Birth Certificate Valid Forever

Processing Time

From submission of application to the issuance of the Certificate of Registration could take up to 18 months.
