Competent Authority
The district administration of the place of residence or habitual residence, or the last place of residence or habitual residence in Austria:

- In Vienna: the Municipal Department 35 (even for people who never had a place of residence or have had habitual residence in Austria)
Note: For foreign nationals, the name change governed by the law of their home state. In Austria these name changes can only be performed if the foreign nationals are stateless, the nationality is unknown and people have habitual residence in Austria or refugees under the Convention relating to the Status of Refugees and the Protocol relating to the Status of Refugees resident or ordinarily resident in Austria.

- Family Name / Surname
- First name (s)
- Residential address
- Date and place of birth
- Nationality (or statelessness unresolved citizenship, refugee status) of the applicant / the applicant
- The reasons why the change of the family name / surname or the first name is requested
- Surname / Last Name and / or first name (s), his or their approval is sought, where appropriate, first name (s) of or to be abolished (s) or their order is to be changed
- Signature of the applicant / the applicant or the legal guardian / legal representative, if the applicant / the applicant is restricted in his / her legal capacity

Legal Grounds for Changing Name
To make the change Familien-/Nachnamen, one of the legal grounds enumerated here must be:
- The previous Familien-/Nachname acts ridiculous or offensive
- The previous Familien-/Nachname is difficult to pronounce or difficult to write
- The applicant / the applicant is of foreign origin, and wants a family name / her it facilitates classification in domestic:
- This request for the name change must be made ??within two years after the acquisition of Austrian citizenship are introduced
