Apply by Mail

  1. To Apply for Foreign Labour Certification, the applicant has to approach the U.S. Department of Labour Employment and Training Administration link
  2. The applicant has to download the report form from the following link
  3. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
  4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  6. Mail the application form to U.S. Department of Labour Employment and Training Administration. The mailing address is given in the “Office Locations & Contacts” of this page.
  7. The applicant has to pay the prescribed fee as requested by the authority.
  8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
  9. Then the application will be processed further. All the updates on the application status will be sent via SMS to the applicant’s mobile number.
  10. Once the verification process gets completed, the applicant will get call or email from the department for interview check through webinar or visiting by office.
  11. The respective officer will inform the date and details for meeting.
  12. Based on the outcome of the above report, and other internal processing, the designated authority will grant the certification.
  13. The applicant will receive the labour certificate through mail.
  14. This entire process can be completed in 30 – 60 days or as per the timeline advised by the respective department authority.

  • Print legibly in ink or use a typewriter. If the applicant needs more space to answer questions in this form, use a separate sheet.
  • Identify each answer with the number of the corresponding question. SIGN AND DATE each sheet in original signature.
  • All copies of this form must bear the original signature of the employer or the employer's duly authorized representative with hiring authority.
  • False statements are subject to Federal perjury and fraud penalties.
  • The authorization of agent is completed only when the employer designates an agent to represent the employer in applying for foreign labour certification.
  • It is recommended that the employer not sign a blank form, since the employer takes full responsibility for any representations of the agent.

Need for the DocumentEdit

  • A foreign labour certification issued by the Department of Labour (DOL) allows an employer to hire a foreign worker to work permanently in the United States.
  • In most instances, before the U.S. employer can submit an immigration petition to the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS), the employer must obtain a certified labour certification application from the DOL's Employment and Training Administration (ETA).
  • The DOL must certify to the USCIS that there are not sufficient U.S. workers able, willing, qualified and available to accept the job opportunity in the area of intended employment and that employment of the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

Labour Certification
Some immigrant visa preferences require you to already have a job offer from a U.S. employer. This employer will be considered your sponsor. For some visa categories, before the U.S. employer can submit an immigration petition to USCIS, the employer must obtain an approved labour certification from the U.S. Department of Labour (DOL). The DOL labour certification verifies the following:

  • There are insufficient available, qualified, and willing U.S. workers to fill the position being offered at the prevailing wage
