Procedure

Apply Online - Online Renew Mining Lease or License Online with Images

1. To apply to renew mining licence online, go to the website Link
2. If already applied for registration or registered to IBM website, then click on login to proceed.
3. If not, select the category of applicant and then click continue.
4. An applicant seeking registration is categorized into four categories: a. Individual, b. Association of Individuals, c. Firm or d. Company.
5. While applying for registration, the applicant should tick the category to which he/she belong.
6. Based on the category selected the appropriate screen will open and further details of applicant will be displayed for filling.
7. The fields marked with * are mandatory fields and information is to be compulsorily provided.
8. Business Activity can be more than one and multiple activities can be selected by holding the Ctrl key.
9. For state, select the state from the drop down list of options and after that select the district.
10. Email is very important as the user id /password /registration no would be forwarded to this email id hence proper email id must be given.
11. Enter the registration number and any one/all (TAN / TIN) of the Company.
12. Enter the details of officer responsible for conduct of business.
13. The details of all Directors of the Company can be entered after clicking the Add button marked ‘+’.
14. Select Citizenship, if selected citizenship is INDIAN/NRI then the PAN number is mandatory and you may enter any one from voter id, passport number or driving license of the Directors.
15. For security question, choose a question and then provide the answer. It is requested to memorize the answer as it would be required for generating fresh password in case the applicant forgets the password.
16. Enter the code displayed and then press continue button.
17. Refer to the “Required Information” section of this page to learn more about the other details you need to fill.
18. Relevant documents as mentioned in ‘Required Documents’ section of this page can be uploaded as needed.
19. After completing the entry of minimum data required for registration, you will be asked for the confirmation about the entries.
20. If all the entries are correct, then you can press Confirm button, otherwise click on Edit/Change button to modify the entries.
21. After clicking on Confirm button, the Application Id and password is communicated to the applicant on the email id indicated while applying for the registration form within 24 hours.
22. In case of any problem, the applicant may approach the concerned Regional office for solution.
23. The applicant can view the status of his application and can edit his details by logging into the system with application id and password communicated to him through e-mail.
24. Further details can be entered now or later by logging with Application id and password.
25. Details like State Licence, Mines Held, PL details, RP details, Storage and Mineral Consumption can be entered by clicking ‘+’ button against the options.

Apply In Person

1. To apply for Renewal of Mining Lease under the Mineral Concession Rules, 1960, you must approach your concerned Drawing and Disbursing Officer, IBM. The address can be found in the ‘Office Locations & Contacts’ section of this page.
2. There, you need to fill in and submit Form J which will be available at the DDO office.
3. To fill in the form, you will need to provide some general details mentioned in the ‘Required Information’ section below.
4. Then, fill in the number and date of the valid clearance certificate of payment of mining dues/ If on the date of application the applicant does not hold a prospecting licence, it should be stated whether an affidavit to this effect has been provided to the satisfaction of the State Government.
5. Refer to the “Required Information” section of this page to learn more about the other details you need to fill.
6. You also need to give details of previous renewal granted.
7. Attach an affidavit, that the up-to-date income tax returns, as prescribed under the Income Tax Act, 1961, has been filed, and tax due, including the tax on account of self-assessment has been paid.
8. Make a detailed mining plan and a tentative scheme of mining for the next five years and add to enclosures.
9. Provide an annual programme and plan for excavation.
10. A plan of the area with regard to natural water courses, forest areas and an assessment of impact of mining activity on said area must be prepared.
11. Offer details of output during the last three years and phased programme for production during the next three years along with a layout plan for development
12. In case of coal, details of existing railway transport facility available and additional transport facility required will need to be mentioned.

    Note:

    • No item/column should be left blank or stroked out. If the information for any column / item is nil it should be so stated. Leaving it blank or making dashes or writing N.A. is not enough. A clear and definite reply must be given.
    • The application should relate to one compact area only.

13. The completed Form J needs to be signed by you and the witnesses and submitted to the regional Controller of Mines (address mentioned in ‘Office Locations & Contacts’ below) Note:
    • If the application is signed by an authorised agent of the applicant, Power of Attorney should be attached.
14. Along with the form, attested copies of relevant documents (as listed in the “Required Documents” section of this page) and a Demand Draft of Rs. 500/- drawn on any nationalized bank, in favour of Drawing and Disbursing Officer, IBM, (name of concerned region) must also be submitted to the DDO.
15. The entire process will take about 90 days to complete.
16. You need to apply for renewal at least 12 months before the expiry of your license.

Eligibility

• Only the license holder or the license holder representative can lodge a renewal application.
• A signed Consent of all holders form must be provided as part of the application.

Validity

The renewal period cannot exceed 20 years.

Instructions

An application for a renewal of a mining right must:
a) State the reasons and period for which the renewal is required;
b) Be accompanied by a report showing the extent of compliance with the requirements of the approved environmental management programme, and
c) Include a detailed mining work programme for the renewal period.

Required Information

• Name of the applicant with complete address.
• For individual applicant, his nationality needs to be mentioned.
• If the applicant is a company, an attested copy of the certificate of registration must be enclosed.
• In case the applicant is a firm or association, the nationality of all the partners of the firm or members of the association must be mentioned.
• Profession or nature of business of applicant.
• No. and date of the valid clearance certificate for payment of mining dues.
• An affidavit stating that up-to-date Income Tax returns have been filed, and the tax due, including the tax on account of self-assessment has been paid.
• Particulars of the mining lease for which renewal is desired.
• Details of previous renewal granted, if any.
• Period for which renewal of mining lease is required.
• Details of surface rights over the area of the land for which renewal of the mining lease is required.
• Consent of the owner and occupier for undertaking mining operations in writing.
• Particulars of the areas (mineral-wise) for which the applicant already holds a mining lease/ has already applied for but not granted/ being applied for simultaneously.
• A mining plan.
• A tentative scheme of mining for the first five years of the lease.
• Details of the geology and lithology of the area, the extent of manual mining and mining through machines
• Annual programme and plan for excavation for next five years
• The plan of the area showing natural water courses, forest areas and an assessment of impact of mining activity on said area.
• Full details of industry for which the minerals are going to be used.
• In case the renewal applied for is only for part of the lease hold, details of the area applied for renewal
• Particulars of map of the leasehold with area applied for renewal clearly marked on it
• Particulars of existing or created dumps of ore, if any
• Means by which the mineral is to be raised, i.e., by hand, labour or mechanical or electric power.
• Manner in which the mineral raised is to be utilised - for manufacture in India/ for exports to foreign countries
• Details of output during the last three years and phased programme for production during the next three years along with a layout plan for development
• In case of coal, details of existing railway transport facility available and additional transport facility required.
• Any other particulars which the applicant wishes to furnish.

Need for the Document

Mining without valid licence is illegal and likely to attract a penalty of up to Rs 25,000 per hectare or two years imprisonment or both.

Information which might help

Having a mining lease renewed is not an automatic process. The concerned regional authority will carry out an assessment on a number of aspects to determine if a renewal should be granted including:

• The land still contains workable quantities of a resource
• The activities on which the previous mining lease term was granted were completed, adjusted and re-scoped where they needed to be
• The objectives for which the previous mining lease was issued had been met
• The activities proposed for the renewal period comply with the purposes for which the resource authority can be issued
• The proposed activities for the renewal term are an appropriate use of Crown land and will conform with sound land use management principles
• The holder/s has access to sufficient and appropriate financial and technical resources to carry out the proposed activities.

To support the renewal application, holders are given the option to supply a statement justifying why they think the renewal should be granted and what benefit will be achieved by granting the renewal. You might like to include in your statement details about:

• Economic viability, market projections and commodity prices
• Summary statements related to what financial and technical resources you have available at your disposal (this will differ from the information to be provided as part of the financial and Technical requirement of the application)
• The overall rationale of what you are trying to achieve
• Any foreseeable constraints or challenges.
