Apply In-Person

  1. Applicant shall approach Sub-Registrar office for registration of deed agreement. Link for contact details Link.
  2. Applicant must procure stamp duty paper as per the amount derived based on the land value to complete the lease deed drafting.
  3. Stamp duty paper has to be given to the officer for typing the lease deed.
  4. The applicant should have the documents mentioned in the "Required Documents" section of this page.
  5. Register the agreement in the Sub-Registrar office respective to your district.
  6. Both the parties and witness should reach the registrar office on scheduled date and time. Signature of witness is useful for evidentiary purposes.
  7. Pay the registration fees as mentioned in "Fees" section given in the page.
  8. After verification by the sub-registrar, the registration is complete after this.
  9. The applicant can get the lease deed from the Sub-registrar office.

  2. The Citizen Registration Form will appear on the screen.
  3. Fill all the details in the form and click on “Submit” tab.
  4. After registration, applicant can login by clicking on “Have an account, Click here” option.
  5. After login, click on “Prepare your own document” option written at right side of the screen. Link to official website Link
  6. Enter all the information correctly in form.
  7. Pay fees as mentioned in “Fees” section on this page.
  8. Scan all the documents as mentioned in “Required Documents” on this page.
  9. For verification, visit your respective Sub-Registrar office as mentioned in “Office Locations and Contacts” on this page.
  10. Both the parties and witness should reach the registrar office on scheduled date and time. Signature of witness is useful for evidentiary purposes. Link
  11. Go on the designated date and time with all the documents as mentioned in “Required Documents” section on this page along with the appointment SMS that you have received.
  12. After all the verification by the sub-registrar, the document will be issued.
  13. Once the verification is over, the registration is completed and document will be issued to the applicant.

Required DocumentsEdit

The documents required for successfully completing the procedure are as follows:

  • Documents required by the Owner for registration:
    • The original proof of ownership or title to property
    • Passport size photos
    • Aadhar card
    • Any ID proof like driving licence, voter’s ID, passport etc.
    • The rental agreement printed on the Stamp paper.
  • Documents to be presented by the Tenant for registration:
    • Two passport size photos.
    • Aadhar card if the person is an Indian. If the person is a foreigner, then original passport is needed.
  • Two witnesses with their original ID proof.

EligibilityEdit

  • The person should be 18 years or older than 18 years to enter into a lease.
  • The person should not have any mental competency issues.



FeesEdit

  • For rent agreement less than 1 year, 0.4% on the whole amount payable on such lease.
  • Where the lease purports to be for a term of not less than 1 year but not more than 5 years, 0.4% on the total rent payable on such lease.
  • Where the lease purports to be for a term exceeding 5 years but not exceeding 10 years, 0.4% on the total rent payable on such lease.
  • Where the lease purports to be for a term exceeding 10 years but not exceeding 20 years, 0.6% on the total rent payable on such lease.
  • Where the lease purports to be for a term exceeding 20 years but not exceeding 30 years, 0.8% on the total rent payable on such lease.
  • Where the lease purports to be for a period in excess of thirty years or in perpetuity or does not purport to be for a definite period, 5% on the value of property under lease as declared by the party or 0.8% on the total rent payable on such lease, whichever is higher.
  • Besides the above stamp duty costs, 0.1% of the total amount also need to be paid towards registration charges.

  • The lease agreement is valid up to the time it is written on stamp paper while registration with the consent of both the parties.

InstructionsEdit

The following details should be kept in mind while taking the flat on lease:

  • You should know whether you are directly dealing with the owner or any third party on the behalf of the owner.
  • You should know if there is any broker or agent in between as they also take their commission charges.
  • Check the Electricity or Tax bill to verify whether the property belongs to the owner who is claiming it or not.
  • Make sure you take a receipt by the owner for any token money you have given or make it through cheque, DD or online transfer.
  • Terms and conditions between the owner and tenant should be clearly written in the agreement.
  • If the property to be leased is used for illegal purposes, the lease would be invalid.
  • Signatures of both the parties on the lease is compulsory. All terms of the contract must be agreed upon by both parties.

  • Lease agreement protects the rights of the both tenant and the landlord in case of future conflicts. A legal document can help both the parties as they can approach the court if any dispute arises between them.

  • The person taking the house for rent is termed the tenant or lessee, and the person letting it out for rent is termed the landlord or owner or lessor.
  • People create rental agreements on Stamp paper of minimum values like Rs.20/- or 50/- or 100/- etc. to save money. But actual Stamp prescribed by the Government should be used. As long as there is no legal dispute between the owner and the tenant things go well but if something happens no one can claim anything in court.
  • It is important to keep track of the time when the deed was created. A fresh deed has to be created after the deed expiration. The registration must be made at least four months before the date of deed expiration. If both the parties are not present at the time of registration of deed, he/she must sign the Power of Attorney, granting attorney the rights of agreement closure.
