Procedure

How to apply:

1. Applicant can obtain the application form from the ministry of interior website or from any of the municipality office near Application Form
2. Accurately fill out the application form and attach copies of all the required documents and submit them to the attending official within the application jurisdiction authority.
3. The building permit application and the accompanying files are sent to the president of the Assemblée Populaire Communal (APC) at the city level. Where the project is located, regardless of the level of jurisdiction.
4. The application is first approved by the city and then transmitted to the DUCH at the Wilaya level. The DUCH (direction de l’urbanisme de la construction et de l’habitat) at the Wilaya (county) level centralizes all building permit requests submitted at the city level and issues a technical opinion (avis technique) after consultation with other technical government agencies: SONELGAZ, forests, civil protection, health, environment, etc. (exact list depends on the type of project).
5. If all the information are in order you will be issued with the permit upon payment of all the required fees

• Plans of the project prepared by a certified architect and certified engineer for the génie civil section. Drawings of the structure
• Sewage system drawing

Instructions

The waliya is competent to issue building permits for projects:

• Public or private facilities of local interest;
• Collective housing projects of more than 200 dwellings and less than 600 dwellings.

The Minister responsible for town planning is responsible for issuing building permits for projects:

• public or private facilities of national interest;
• collective housing projects of more than or equal to 600 dwellings;
• Works, constructions and installations carried out on behalf of foreign States or international organizations of the State, its public establishments and concessionaires;
• Energy production, transport, distribution and storage works.

The President of the People's Municipal Assembly is responsible for the rest of the building permits other than those listed above

Need for the Document

In accordance with the provisions of articles nos 49, 52 and 55 of law n ° 90-29 of December 1, 1990 relating to development and town planning and in compliance with article 1 of this decree, any new construction or transformation of construction including work relating to the change of:

• Footprint, template,
• facade,
• vocation or destination,
• supporting structure,

Appeal of decision regarding your application:

• The applicant who is not convinced of the response notified to him, or in the event of silence from the competent authority within the required time limits, may lodge an appeal against acknowledgment of receipt with the wilaya.

In this case, the deadline for issue or reasoned refusal is fifteen (15) days.

If the applicant does not receive a response within the prescribed period following the filing of the appeal, a second appeal may be brought to the ministry responsible for town planning.

• In this case and on the basis of the information transmitted by the town planning services of the wilaya, the departments of the ministry responsible for town planning will instruct them to respond favorably to the applicant or to inform him of the reasoned refusal. , within fifteen (15) days after the filing of the appeal.

Legal action can be brought before the competent court
