Apply Online

1. To Apply for Prevailing Wage Determination, the applicant has to make the application online via Foreign Labor Application Gateway link
2. The applicant can click “Sign In” and enter their email id and password. if the applicant doesn’t have an account the applicant can click “Create an Account” and enter their credentials and create an account.
3. Once logged in, the “New Application” tab will automatically launch. The “New Application” tab is used to begin the application process. Click “Create New” to begin your ETA-9141 application. This can be used for an H-2B, H-1B, or PERM Prevailing Wage application. Or the applicant can click the “Create New” under CW-1 Prevailing Wage.
4. Review “Employment-Based Visa Information.” All required fields within the application are marked with an (*). The status of each section on the stepper will indicate completion. Scroll down and select the application type from the dropdown menu. Click “Continue.”
5. Enter “Requestor Point of Contact” information and “Employer Information” into the required fields and validate. Click “Continue.”
6. Enter “Wage Processing Information” into the required fields. Indicate if the employer is using a Collective Bargaining Agreement. If “Yes,” upload proper documentation.
7. Indicate whether the employer is requesting a survey for consideration in determining the Prevailing Wage. If “Yes,” enter “Survey Name,” “Survey date of publication,” and proper documentation.
8. Enter “Job Description” and “Minimum Job Requirements” into the required fields. If there is a minimum degree required, enter the major or field of study when prompted. If a there is a secondary degree required, enter the major or field of study when prompted.
9. If training experience is required, enter the number of months of required training and the field names of training. And if employment experience is required, enter the number of months of experience and the previous occupation. Click “Continue.”
10. Enter “Place of Employment” information into required fields.
11. Validate the information included on the system-generated PDF. Use the stepper to navigate back to any section if changes are necessary.
12. Once validated, click “Submit” to submit your ETA-9141.
13. The applicant has to pay the prescribed fee as requested. (If Applicable)
14. The processing time for this procedure takes up to 30 days.

Apply By Mail

1. To Apply for Prevailing Wage Determination, the applicant has to approach the U.S. Department of Labor Employment and Training Administration link
2. The applicant has to download the application form from the following link

   • ETA-9141C Application link
3. The applicant has to enter all the details in the application form. (Incomplete application forms are not accepted)
4. Make sure that the applicant has to attach all the necessary documents that are mentioned in the “Required Documents” section of this page.
5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
6. Mail the application form to U.S. Department of Labor’s Office of Foreign Labor Certification. The mailing address is given in the “Office Locations & Contacts” of this page.
7. The fee for this procedure has to be paid as per the authority’s request.
8. Once the verification process gets done by the officer, the applicant gets the notification from the department.
9. The applicant gets the certificate by post or email.
10. The processing time for this procedure is takes up to 30 days.

• Employers can obtain this wage rate by submitting a request to the National Prevailing Wage Center (NPWC), or by accessing other legitimate sources of information such as the Online Wage Library, available for use in some programs. The requirement to pay prevailing wages as a minimum is true of most employment-based visa programs involving the U.S. Department of Labor. In addition, the H-1B, H-1B1, and E-3 programs require the employer to pay the prevailing wage or the actual wage paid by the employer to workers with similar skills and qualifications, whichever is higher. The U.S. Department of Labor's Bureau of Labor Statistics has provided wage data collected under the Occupational Employment Statistics (OES) program for use in the foreign labor certification process since 1998.
