Apply In Person
- To Apply for Plant Variety Protection Certificate, the applicant has to approach the U.S. Department of Agriculture, Agricultural Marketing Service link
- An application form will be provided to the applicant by the authority officer or download the application form from the following link.
- The applicant has to enter all the necessary details in the application form.
- Make sure that the applicant has to attach all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit the application form and the documents to the authority officer.
- The applicant has to send the seed sample to the NCGRP.

- The fee for this procedure has to be paid while submitting the form, payment details are mentioned in the “Fees” section of this page.
- NOTE: Payment can do either by credit card or through cheque.
- Once the authority receives applicant’s application, they review it and contact the applicant if they have questions. The authority might request additional documents from the applicant before they can proceed.
- Once all the verification is done by the authority, the applicant receives a notification through a mail for getting a certificate.
- The applicant has to visit the respective department to collect the certificate within a month.

- The person must be a U.S. national, national of a UPOV member country, or national of a country which affords similar protection to nationals of the U.S. for the same genus and species.
- If the rights to the variety are owned by the company which employed the original breeder(s), the company must be U.S. based, owned by nationals of a UPOV member country, or owned by nationals of a country which affords similar protection to nationals of the U.S. for the same genus and species.

- The fee has to be paid while submitting the documents - $4,382.
- NOTE: Payment can do either by credit card or through cheque.

- Validity for plant variety protection certificate is 20 years.

- The Plant Variety Protection Office (PVPO) provides intellectual property protection to breeders of new varieties of sexually reproduced, tuber propagated, and asexually reproduced plant varieties.
- Our certificates are recognized worldwide and allow faster filing of PVP in other countries. Certificate owners have rights to exclude others from marketing and selling their varieties, manage the use of their varieties by other breeders, and enjoy legal protection of their work.
