Need for the Document

• Permanent employment is an employment relationship where an individual works for an employer and receives payment directly from them. This type of employment arrangement does not include a set end date.
• The permanent Employment certification program (or PERM) is run by the U.S. Department of Labor’s (DOL’s) Employment and Training Administration (ETA). Its primary purpose is to assess whether the hiring of a non-U.S. citizen employee would prevent equally capable U.S. workers from procuring similar positions. In the course of its assessment, ETA evaluates whether recruiting a non-citizen would have detrimental effects on the working conditions or wages of U.S. workers employed in a similar field.

The list of conditions that require the submission of a new original permanent labor certification in support of the petition includes, but is not limited to:

• The successor entity (petitioner) has not established that a successor-in-interest relationship exists between the successor and the predecessor in accordance with the three successor-in-interest factors.
• The permanent labor certification is not valid for the new geographic area of the beneficiary’s proposed employment.
• There has been any other material change in the job opportunity covered by the original permanent labor certification.
