Kenya - Apply for a Telecommunication's Contractor License

Apply In Person

  1. The application for a Telecommunication Contractor License shall be made to the Communications Authority of Kenya (CAK).
  2. The application shall be made in writing using a prescribed application form - Telecommunications contractor license application form, issued freely at any of the Communications Authority of Kenya offices or use this link to download Telecommunications contractor license application form
  3. Upon obtaining the application form, the applicant should legibly complete the form, attach all relevant supporting documentation as listed under the “Required Documents” section of this page and submit the complete application file to the Telecommunications Licencing Section for processing and consideration.
  4. On submission of the application file, the CAK licensing officer will check for discrepancies or ineligibility in the application documents. If a discrepancy that cannot be immediately corrected exists in any of the documents, the application and all the submitted documents will be returned to the applicant and should not be re-submitted until the discrepancy has been rectified.
  5. It is only after the deposit of the complete file that the CAK licensing officer shall then issue the applicant with a payment instruction form, you should then proceed to make payment for the application fee of Ksh 1000.00 at the CAK Finance and Accounts office and obtain a payment receipt.
  6. Submit the proof of payment receipt with the Telecommunications Licencing office, to finalize the application process and obtain notification of approval for contractor license as proof of submission of the application.
  7. The completed application file is then submitted to an authorized officer (via designated channels) where the application is reviewed and a recommendation made between 23-36 days.
  8. After the lapse of the processing time, applicants should visit the CAK licensing office, if the approved applicant will be issued with a payment instruction form to pay an insurance license fee of Ksh 7500 plus an annual operation fee of Ksh 3000, before being issued with the telecommunication contractor’s license and a compliance certificate.


Appeal to the Tribunal

  1. Any person who is aggrieved by the decision of the Commission not to issue the license or the terms of the license may appeal to the Tribunal within thirty days from the date of the decision.





Required Documents

  • Duly completed and signed Telecommunications contractor license application form
  • Application cover letter (original) drafted on the company's letterhead
  • Commitment letter (original). This is issued by technical personnel of class A (IMWE) registered with the Communication Authority
  • Certificate of incorporation. For local companies
  • Certificate of compliance (copy). For branches of foreign companies
  • List of shareholders and directors- CR 12 (original). It should not be two months old from the date of issuance
  • Tax compliance certificate (copy). It should be valid
  • Identity card. Of the directors listed in the CR 12 (List of shareholders ) if they are Kenyan, or
  • Passport (copy). The directors listed in the CR 12 Form if non-Kenyans and should be notarized.

Eligibility

  • All Individuals or companies interested in Kenya Telecommunications as a contractor are eligible to apply.




Fees

  • Application fee Ksh 1000.00 (non-refundable)
  • After approval and before issuance of Licence Fees Ksh 7,500.00
  • Annual operation fee payable on/or before 1st July of each year Ksh 3,000.00


Note: Payments can be made in cash; Banker’s or Company Cheque at the Cashier’s office on the ground floor at CA Centre. The Cashier’s office is open between 0900 and 1200 hours and in the afternoon from 1400 to 1600 hours on weekdays (and closed on public holidays and weekends).




Validity

  • The license shall expire at the end of the license term specified in that license, but shall be subjected to an annual operation fee payable on/or before 1st July of each year.

  • Registered office and permanent premises details
  • Details of shareholders and directors of Organization / Company.
  • Certificate of Incorporation with the Communication Authority of Kenya (CAK), if a company.
  • A certified true copy of memorandum & Articles of Association details
  • Tax Clearance Certificate details
  • Information on a random sample of the equipment that was done and technical and conformity tests that were conducted by CAK.
  • Name of Applicant (or Authorized Representative)
  • Evidence of compliance with tax requirements.
  • Declaration by the applicant
