Upon receiving the application documents, the responsible staff member of the Foreign Trade Management Division will, within the quota basket allocated by the MOFCOM, study the application and make proposals on whether the import or export license shall be issued to the applicant and submit the proposal to the division director who is to make the final decision.

When applying for the import and/or export licenses of commodities of which the trade is subject to licensing, the applying trading company shall submit the following documents:

• Evidence of the import or export quota
• Application form for the licenses
• Contract and invoice of the trade transaction
• well-printed license certificate for passive export quota of textiles, computer sample check disk and the approval commentary sheet.

Companies with import and export trade right

For commodities of which the import and export are subject to licensing as stipulated by the Ministry of Foreign Trade and Economic Cooperation

Each import and export license costs 20 yuan, the certificate of country of origin of textiles 30 yuan and handmade certificate 10 yuan. The prices have been ratified by the State Pricing Bureau

The Issuing of import and export licenses (active and passive quotas)

Means of Supervision

• According to the stipulations of the Foreign Trade Law of the Peoples Republic of China, import and export licenses are not allowed to be sold second hand, revised or counterfeited. Those who act as above will be brought to the criminal court.
• Validity of the import and export licenses: the closing date for the issuing of import and export licenses is each Dec 31. Export license is valid for three months and shall not exceed the second month of the year next to the current quota year. Import license is valid for one year and shall not exceed the third month of the year next to the current quota year.
• The extension, alteration and renewal of import and export licenses: the extension and alteration of import and export licenses must be based on the application submitted by the license holder within the validity period. New licenses will be issued if the application is accepted by the licensing authority.
• License holders shall take measures to avoid the loss of the licenses. In case the license is lost, the holder shall report the loss to the licensing authority with due loss evidence. The licensing authority will then report to the MOFCOM and implement the remedies adopted by the ministry.
