Procedure

Step one

• This stage involves making an application on the headed paper of your company to the minister of petroleum resources requesting to operate a petroleum drill rig or lease indicating the sufficient technical knowledge and experience,and financial resources to effectively operate a petroleum drill rig. visit their website on the following link link

Step two

• Take the copy of the application and person payee ID to the nearest designated bank to pay for the Application form.

Step Three

• After, Attach all the necessary document which include (company certificate of registration, profile of directors, Bank statement, Partnering organization or firm in exploration, Proof of technical experience from previous work in petroleum drill rig, location of the Business,telephone contact,Email address or website of the business, Mission and objectives of the organization, proof of payment of registration etc.Take you application to the department of petroleum resource ministry of Energy and mineral development for further processing.

Step Four

• Take your Filled application form to the Ministry of Energy and Mineral development department of oil exploring ,alongside with the original copies of your company details, particulars of referee (a valid company license, insurance certificate, proof of ownership the Business and certificate of competence) for verification. Here your Details and particulars of the organization will be uploaded into the database.

Step Five

• After successful capturing of your details into the database,a temporary slip will be issued to you as a proof of receiving your application, this usually depends on the readiness of your application.Then wait for approval or rejection depending on the decision of the Board.
• When the Minister in charge of Energy and Mineral Development is satisfied with all the applicant's work and reports submitted by the licensee, he/she will instruct the in-charge to process the permit . Then the Authority permits in writing the Department in charge of Petroleum Resource to grant a license to the applicant to operate a petroleum drill rig. When the License is ready the applicant will receive an sms or a call or email notifying him/her to pickup the license at the Ministry of Energy and Mineral development.

Note 1

• The Minister of Energy and Mineral Development is responsible for making regulations on matters relating to Petroleum Drill rig (PDR) and oil mining leases (OMLs),including matters relating to safe working, inquiries into accidents and the prevention of pollution of water courses and the atmosphere/
• The License for petroleum drill rig is granted by the Minister who depends on the recommendation of the Directors General of the Department Petroleum Resource and in accordance with guidelines, impose special terms and conditions that are to be followed in petroleum drill rig:

The minister consider the following to take a decision of issuing a license,

• participation by the Government in the venture to which the license or lease relates, on terms to be negotiated between the Minister and the applicant for the license or lease; and exploitation of any natural gas discovered.
• If the applicant is not inconsistent with the provisions of the Act on any license or lease to which the Act applies,including terms and conditions as stated in the Act then the license can be revoked.

Note 11

• Ownership of land does not confer title to the petroleum resources in the subsoil. The entire ownership and control of petroleum resources remains vested in the Government of Uganda.
• The petroleum drill rig permit does not apply to any indigenous company operating in the upstream sector whose aggregate production is less than or equal to fifty thousand barrels per day of crude oil or natural gas equivalent.
• Every process needed to process the license must be followed to the later. First, know that petroleum drill can only be valid based on the consent of the Minister of Energy and Mineral development and the applicant fulfilling the following conditions:
• Is of good reputation, a member of a group of companies of good reputation, or is owned by a company or companies of good reputation.
• Has sufficient technical knowledge and experience, and sufficient financial resources to effectively operate under the license or lease.
• For renewal is made at least three months before the date of expiry of the license.

Required Documents

• A completed Application Form is required to process petroleum drill rig permit.
• A copy of Certificate of Incorporation for proving the validity of the company.
• A Certified true Copy of Memorandum and Articles of Association for the company
• A Certified True copies of Form E.for completing the application.
• A bank Draft Drawn in the favour of the Uganda Government.
• A copy of bank Draft should be attached on the application form
• A Copy of Current Tax Clearance Certificate.
• A VAT Certificate from URA should be attached on the application form
• A Company Profile showing the brief history of the company
• A comprehensive Staff List and Curriculum Vitea of the key Staff required to run and manage the company,
• A List of equipment facility to the company to prove capability to run the petroleum company.
• DRP Endorsed Request for Expatriate Quota
• Training Program for Ugandan Staff for continuation of the human resource
• Registration by relevant professional bodies in charge of petroleum in Uganda
• A copy of technical agreement of MOU with Ugandan company/DPR Accredited laboratory.
• Current Workmen compensation policy is required in the processing of this License
• Community Affairs, Safety, health Environment and security,from NEMA and other bodies
• Copy of current Medical and Retainers-hip agreement with the Hospital or clinic
• Copy of company ID of staff handling for the company should be attached on the application form.

Eligibility

• All companies and other stakeholders who wish to drill petroleum in Uganda.
• Any company qualified under terms and conditions prescribed from time to time by the relevant Institutions is free to apply for the grant or award of a license, lease or contract, as the case may be,for the petroleum drill and production of petroleum to the Management of Petroleum Resources

Fees

The License fees to operate a petroleum drill rig is 20,000 US Dollars.

Instructions

• All applicants for Petroleum drill rig must register with Ministry of energy and Mineral Development , and be familiar with the rules relating to petroleum drill practice in Uganda.

Required Information

• Name,address and nationality of the applicant. (If body corporate, provide the corporate name, registered office address and place of incorporation).
• Tax Identification Number /VAT Registration Certificate.
• Corporate status of ownership (sole proprietorship, partnership, unincorporated business, incorporated private/public company, association or a co-operative)
• If the body corporate is incorporated outside Uganda, proof of establishment of the place of business in Uganda and registration as a foreign company in accord.
• Proposed location of project (District, county, sub county, parish and village)
• Size of Plot (in Hectares) on which the facility is to be constructed.
• Expected date of commencement of construction.
• Estimated date of completion of the project.
• Name, address and qualifications of the potential principle contractors and supervisors to be employed for the project or company to undertake the construction/modification.
• Proof or commitment of insurance for protection against third party liability, and other construction liabilities.
• Description of the project and amount of investment capital, supported by a Bank Reference Letter.
• Description of safety programmes, equipment and plans for protection of occupation health, industrial safety and environment during regular construction operation as well as contingency plans for accidents, natural disasters and emergencies.
• Any other additional information considered relevant to this application

Need for the Document

• In order for the person who wish to drill petroleum in Uganda is free to apply for exclusive right to drill petroleum. This is done to ensure a safety standards and regulate the drilling of petroleum in the area, the Ministry of Energy and mineral development requires that anybody who intends to drill petroleum must apply for a license.

• The Act provides that a licensee shall not operate a drilling rig without a valid permit issued by the Authority in accordance with terms and conditions specified in regulations issued by the Authority. The procedure for application for a permit to operate a drilling rig shall be prescribed in regulations
