  1. If any school which has been classified and registered as private school remains closed at the instance of the school owner for a period exceeding thirty working days, other than during normal school holidays, the school owner shall immediately notify the Permanent Secretary, chief administrative officer or town clerk, in writing of the same.

  2. If the Permanent Secretary, chief administrative officer or town clerk is satisfied that the reasons given by the school owner or the period during which the school is likely to remain closed are contrary to the national interest, he or she may, in his or her absolute discretion, after giving the school owner an opportunity of being heard, direct that the school be reopened under the management and control of a statutory manager appointed by the Permanent Secretary, chief administrative officer or town clerk, and thereupon shall apply to the school
  3. Every school owner who fails to furnish the information required by sub-section (1) of the section of rules and regulation commits an offense and shall be liable on conviction to a fine not exceeding ten currency points or to imprisonment for a term not exceeding five months or both.
  4. By closing his or her school or cancelling the classification or registration and ordering the closure of his or her school, may, within thirty working days beginning with the day on which the decision was communicated to him or her, appeal to an appeals tribunal as established under section 53 of the Act.

Required DocumentsEdit

  1. Attach copy of the license letter on the application form.
  2. The original certificate of registration of the school should be attached on the submitted application.
  3. Minutes of the BOG approving and/or recommending the up-grading of the school by setting up a dormitory section.
  4. The District Inspector of Schools’ report showing the Dormitories and other related Accommodation facilities.
  5. Report showing the list of basic facilities for the dormitory section and approved drawings (Building plans) available.
  6. Proof document showing Dormitory Occupancy permit.
  7. Certificate of Occupational Safety and Health from the health official.
  8. Approved plan for water and sanitation system in the dormitory.
  9. A list of safety promotions and injury prevention available in the dormitory. (Fire safety system).

  • Every school owner who fails to furnish the information required by subsection (1) to the Permanent Secretary, chief administrative officer or town clerk commits an offense and is liable on conviction to a fine not exceeding six thousand shillings or to imprisonment for a term not exceeding six months or both.

Information which might helpEdit

  • Any school which has been closed by the order of the chief education officer made under section 28 or 29, and which has remained closed for not less than six months, may be permitted by the chief education officer to be reopened and to be entered again in the register of private schools with such classification as the chief education officer thinks fit, without any application being made in that behalf by the school owner.
  • Any school reopened pursuant to subsection (1) shall, unless the chief education officer otherwise directs, be deemed to be an establishment of a new school and, accordingly, the provisions of this Act which relate to the establishment of a new school shall apply.
  • Every school owner shall manage his or her school in such a way that the interests of the pupils shall be supreme.
  • A school owner may charge such school fees as the Permanent Secretary, chief administrative officer or town clerk may from time to time prescribe.
  • The Ministry responsible for education may from time to time issue instructions to school owners on aspects of management of schools with a view to safeguarding the interests of the pupils, and every school owner shall comply with the instructions.
  • Every school owner shall establish for his or her school a board of governors or a management committee, as the case may be, in accordance with the regulations made under the Act.
  • Every school owner shall prepare annual estimates of his or her school and shall, on request made by an inspector of schools, make them available for inspection by the inspector of schools or an officer of the Ministry responsible for education.
  • Every school owner shall have the accounts of his or her school audited annually by a professional accountant, and the audited accounts shall be made available for inspection on request being made by an inspector of schools or an officer of the Ministry responsible for education.
